记者从上海松江区检察院获悉，近日，该院以涉嫌传播淫秽物品牟利罪对犯罪嫌疑人赵某批准逮捕。
32岁的赵某自2013年开始经营一家电脑科技有限公司，主要做一些弱电工程和维护，平时的生意不温不火，赵某自己对公司的业绩并不是很满意。正常业务之外，赵某也曾凭借自己掌握的网络技术，制作过非法网站，利用一些破解程序从网上采集色情电影的视频，进而牟取经济利益。
2015年夏天，一个偶然的机会，赵某从网上认识了一位朋友，对方运营着一个淫秽视频整理汇总类型的网站，网站本身并没有存放淫秽视频文件，但是网页上所有的链接基本都是非法视频资源。经过商议，对方把网站的后台用户名和登录密码给了赵某，赵某负责运营维护，并收取一定的费用。过了一段时间，对方与赵某失去了联系，网站也逐渐由赵某一个人控制。因为自己有对网站的绝对管理权限，赵某便将网页上的广告全部去掉，并将自己所有的淫秽视频文件的链接挂到网站上。
然而，网站并没有设置会员登录权限，网友在网站上点击链接并观看视频也不会给自己产生任何利润。有着多年的IT业务经验，赵某自然懂得如何获取丰厚利润。之后，赵某在网上广泛地联络广告公司，拿到对方的广告嵌入代码后，将广告前置在视频播放页面。如此，只要有网友点击观看视频，广告便会强制弹出。广告公司根据后台统计的点击量，以有效点击1000次给付4-5元的金额跟赵某结算，并且每周结算一次，费用直接转到赵某银行卡或者支付宝账户。
据赵某到案后的供述称，其管理维护的网站数据库中约有上万部淫秽视频，网站日均不重复浏览的ip有五六千，对应的浏览量至少有五六万，节假日高峰时的浏览量甚至能达到二十多万，每月跟广告商结算后，毛利基本都在10万元以上，除去自己租用服务器的维护费，剩下的就是纯利润。后经上海新闻出版局鉴定，从赵某经营的网站中固定了3万余条视频播放链接，其中随机提取出200个视频文件，竟有193个属于淫秽文件。
记者从承办该案检察官处了解到，赵某以牟利为目的，利用互联网、移动通讯终端制作、复制、出版、贩卖、传播淫秽电影、表演、动画等视频文件，应予立案追诉。从其网站随机下载的200个视频文件经鉴定后，其中有193个属于淫秽文件，远远超出立案追诉标准，故其行为已经构成传播淫秽物品牟利罪。日前，上海松江区检察院以涉嫌传播淫秽物品牟利罪对犯罪嫌疑人赵某批准逮捕。
另据《刑法》相关法规：“以牟利为目的，制作、复制、出版、贩卖、传播淫秽物品的，处三年以下有期徒刑、拘役或者管制，并处罚金；情节严重的，处三年以上十年以下有期徒刑，并处罚金；情节特别严重的，处十年以上有期徒刑或者无期徒刑，并处罚金或者没收财产。”目前，赵某一案仍在进一步审理中，等待他的将是法律的严厉制裁。
