　　南方日报讯 （记者/魏亚男 通讯员/张方针 刘永红） 近日，佛冈县人民法院以玩忽职守罪依法追究汤塘林业站副站长李某营刑事责任，判处有期徒刑二年，缓刑三年。

　　据了解，汤塘林业站副站长、生态公益林管护人李某营，对盗伐林木行为不采取有效措施予以制止，致使公益生态林遭受重大损失，对生态环境造成了严重破坏。

　　2013年6月底，刘某、谭某等人借砍伐黑山面（地名）公益生态林山场的病虫害树的名义，在没有取得林业行政部门林木《采伐许可证》的情况下，雇请工人擅自盗伐该山场的林木予以销售牟利。李某营违反规章制度，多次接受刘某的宴请，在发现刘某等人有盗伐林木的行为后，仍不正确、认真履行其作为林业站副站长、生态公益林管护人对辖区内生态林的监督、保护职责，采取不立案、不调查、不汇报、不处理，仅通过电话以口头形式制止。由于没有采取有效措施及时制止盗伐林木的行为，致使公益生态林遭受重大损失，对生态环境造成了严重破坏。

　　经鉴定，该山场被盗伐面积304.74亩，盗伐林木总蓄积613.8163立方米，总出材量386.7043立方米，总株数5456株。

　　法院审理认为，李某营身为林业主管部门工作人员，明知他人盗伐林木，没有采取有力的措施予以制止，严重不负责任，不正当履行职责，致使集体利益遭受重大损失，其行为已构成玩忽职守罪，鉴于其归案后认罪态度较好，有悔罪表现，遂作出上述判决。
