  法制晚报讯(记者 王思思 王岗 谢家乐)近日,一则“2.6亿古董托运摔碎,航空公司按100元/公斤赔偿”的新闻受到关注。《法制晚报》记者整理了2014年以来的18起行李运输差错事件,发现无论旅客损失的行李价值有多高,航空公司实际赔偿金额却相差无几,平均为890元。


  根据现行的民航规定,行李损失确实“按斤赔偿”,标准为每公斤50元至100元。对此,行业专家认为,相关规定已沿用20年,已经滞后。业内提醒旅客,贵重行李物品不要托运,要随身携带。

  记者查询了2016年1-3月航空运输消费者投诉情况,根据通报显示,航班问题仍然占最大比例,行李运输差错排名第四。在关于行李的投诉中,行李破损和丢失的最多,占比近四成。


  记者盘点了2014年以来媒体报道的18起行李运输差错事件发现,其中有6起行李箱及箱内贵重物品丢失;有7起行李箱破损、变形;此外,还有3起古董瓷器破损,1起高尔夫球包丢失,1起宠物狗死亡事件。


  统计显示,18起事件中,破损或丢失物品的价值在媒体的报道中显示为1000元至2.6亿元不等,但实际赔偿金额却差距很大,从100元至2400元,其中相差最大的就是前述2.6亿元古董瓷器破碎事件,据媒体报道,事主称古董的价值为2.6亿,事后仅赔偿1500元,价值与赔偿金额相差173333倍。


  统计显示,公布赔偿数额的15起事件中,实际赔偿的平均金额为890元。


  追访 民航规定“按斤赔偿” 专家认为“滞后”


  记者发现,航空公司“按斤赔偿”并非“霸王条款”,确实“有法可依”。


  根据1996年出台的《中国民用航空旅客、行李国内运输规则》规定,旅客托运的行李全部或部分损坏、丢失,赔偿金额每公斤不超过人民币50元。在2006年3月28日公布的补充条款《国内航空运输承运人赔偿责任限额规定》中,这一标准提升为每公斤100元。


  随后,记者咨询了国内几家大型航空公司,发现他们普遍按照每公斤最低50元、最高300元的标准赔偿行李损失。


  对此,民航专家张起淮表示,“现行规定严重滞后,是导致旅客索赔无门的主要原因,1996年发布的规定至今已经20年了,尽管2006年曾经调整过一次,但这种调整幅度远远跟不上物价的变化。”

  贵重物品可保价


  超规物品走货运


  某航空公司相关负责人告诉记者,旅客携带的金、银、珠宝、首饰、货币、有价证券、文件、合同等贵重物品,是不能作为托运行李或夹入行李内托运的,而应作为自理行李或免费随身携带物品带入客舱。


  如果本身行李箱、衣物等比较贵重,可以在办理行李托运时向值机柜台工作人员提出做“保价”处理。不过每个旅客保价行李价值最高限额为人民币8000元。超过规定限额,需要缴纳价值的5%作为服务费。


  此外,对于古董花瓶这种超规格的物品,建议还是走货运运输,可以有更好的保护措施。
