《法制晚报》记者发现，拍拍网的部分网店曾进行枪支弹药交易，涉案的甚至包括64制式手枪和64制式子弹。
记者梳理26起于2012年3月至2015年12月宣判的此类案件发现，这些案件涉枪86支，涉子弹1687发。近半数案件系交易1年以上才被警方发觉。其中，因“快递公司检查时发现寄送的物品疑似枪管而报案”的案件，只有1起。
拍拍网上买卖枪支弹药
3年多宣判26起
日前，记者从国内各地法院了解到2012年3月至2015年12月期间，26起因在拍拍网上买卖枪支弹药发生的刑事案件的资料。这26起案件涉及被告人52名。其中，部分被告人系利用从拍拍网上购买的枪支弹药，实施绑架、抢劫、故意伤害等犯罪活动。
案例
不法分子购买发令枪改装后绑架抢劫
2013年12月6日凌晨1点40分，出租车司机王某在承德市某小区附近搭载了两名男性乘客，到达目的地后坐在后座上的人用手勒住了他的脖子，拿一把手枪顶住了他的头，坐在副驾驶位置上的人按住他的胳膊，也掏出手枪。
之后，两名持枪者将王某的眼睛蒙上，嘴用胶带封住，给他戴上了手铐，把他塞进了后备厢，还抢走了他身上的钱和手机。
两名持枪者的作案目的，不是抢个的哥这么简单。
中学生张某作证称，当天早上6点半，他上学走到半路，从一辆出租车上下来两个男的，把他拽进出租车塞到后座上，其中一人拿枪指着他的头，给他戴上了铐子。
车开动后，其中一人用张某的手机与其父母通话，让10点之前凑足50万，否则“收尸”。
之后，绑匪开车到一偏僻处，给张某和王某缠上胶带，铐在一起离开。后张某用石头把自己和王某身上的胶带划开，找到好心人帮助报了案。接到报案后，警方在交易赎金地点设伏，绑匪开枪拒捕，但最终还是被抓获。
俩绑匪一个姓高，一个姓刘。破案后，警方作出电子数据检验报告，交易记录显示，绑匪的枪支弹药是从拍拍网上购买的。物证鉴定所枪支检验鉴定报告证实，送检的3把枪系发令枪改装，能够正常击发，具有杀伤力；60发子弹均由发令枪子弹改制，能够正常击发，具有杀伤力。
绑匪高某也承认，绑架、抢劫时使用的枪和子弹是他从拍拍网买的，费用和刘某均摊。
2014年8月4日，河北省承德市中级法院以抢劫罪、绑架罪判处高某、刘某有期徒刑20年。
26起已宣判案件中
涉枪86支、子弹1687发
26起案件中，有21起案件在判决书中说明了买卖枪支的理由。其中七成出售的目的只是为了非法牟利。
法制晚报记者注意到，在拍拍网上买卖的各类枪支，有86把；子弹共1687发。
26起案件，有10起案件在判决书中提及了买卖枪支及配件的收入情况。记者统计发现，截至案发，被告人人均获利14.9万元。
记者还就25起能查到非法买卖初始时间的案件作出统计，结果发现，在拍拍网上买卖枪支弹药，有近半案件在一年后才被查获，其中有3起案件，被告人非法销售了3年后才被警方查获。
其中，因“快递公司检查时发现寄送的物品疑似枪管而报案”的，只有1起。

拍拍网上买枪支子弹加工改装获刑5年
2010年至2013年8月，沈某在拍拍网等处购买了仿制64式手枪、左轮手枪、瓦斯气手枪、64式礼品枪、左轮礼品枪、M1911瓦斯气手枪、单管猎枪各1支、发令枪2支、各类枪支子弹及黑火药、猎枪子弹垫片、半成品手枪枪管、半成品手枪弹夹、制枪图纸、手电钻、子弹发射测速仪等制造、改造枪弹的工具，在其租住屋内对部分枪支弹药进行加工、改装。
2013年11月13日，公安机关接群众报警后将沈某抓获。2014年4月1日，湖北省武汉市新洲区法院以非法制造、买卖枪支、弹药罪判处沈某有期徒刑5年。
法晚记者注意到，26起案件中，有11起案件系通过拍拍网买卖枪管等枪支零配件，之后买主自行组装枪支。
有9起案件，被告人系通过拍拍网买卖射钉枪、发令枪，之后买主自行改装成具有杀伤力的枪支。26起案件中，有18起案件的被告人对枪支进行了改装。
如果说上述买卖还具有一定的隐蔽性，那在拍拍网上直接买卖自制64手枪的做法就令人恐惧了。这样的案件，有3起。
案例
网店用快递寄送配材买家制出64式子弹
2013年5月，李某通过拍拍网，从明某经营的网店购买成套的“64式”弹头、弹壳及底盖，明某将成套弹壳、弹头、底火盖通过快递邮寄给李某，李某从网上购得射钉枪子弹，以提取射钉枪子弹内火药填装到“64式”弹壳再加固弹头的方式，加工制造仿“64式”子弹。
2013年10月8日，警方从李某家中查获大量疑似枪支、弹药、弹药散件的物品。经鉴定，101发子弹为弹药。
6份拍拍网订单和3份快递单证实，李某与明某通过拍拍网交易弹头、弹壳等物品的犯罪事实。
警方还发现，李某和他的妻子都是冰毒的瘾君子。
李某供述称，自己改装枪支的技术，是从网上和兵器杂志上学到的。
法院认定，李某从他人处购买了4把钢珠枪，将其改装成4把能打64制式子弹的手枪。
法院认为，公安机关在明某住处查获数万枚仿制式子弹头、弹壳、底火盖等弹药散件及加工制作工具，且明某在网上贩卖弹药散件，李某从明某处购买弹药散件后加工改制成子弹，子弹经鉴定均是弹药，足以认定明某非法买卖弹药散件的行为危害了公共安全，构成非法买卖弹药罪。
2015年1月30日，四川省绵阳市中级法院以非法制造、买卖枪支、弹药罪判处李某有期徒刑11年，以非法买卖弹药罪判处明某有期徒刑4年。

如果有人在拍拍网购买枪支弹药用于犯罪导致无辜公民受害，拍拍网是否应承担责任？如果确实应承担赔偿责任，那么，如今拍拍网已关闭，谁该来替它承担责任？
北京市律师协会消费者权益法律专业委员会秘书长耿军律师表示，按照目前现行的法律规定，拍拍网属于电子商务平台，平台的职责是审核卖家的相关资质，如果受害者可以取证到拍拍网明知有网店在销售违禁品却不制止的证据，则可以起诉拍拍网索赔，要求其承担相关责任。
中国电子商务协会高级专家、中国移动研究院智囊团成员庄帅在接受法晚记者采访时说，电商平台的监管确实存在难度，论坛与其他网站的监管可以设置关键词进行检索屏蔽，但电商平台只能通过巡查发现问题。
庄帅表示，在目前的现状下，只有平台加强巡查，及时发现问题尽早处理；监管部门加大惩罚力度；搭建更便捷的投诉渠道和机制，让更多的网民加入监督行列，才能实现电商环境的净化。
