辅警“临时工”之惑:月薪850元 执法中常受嘲笑|辅警_新闻资讯

从事辅警工作15年的曹文玉，是我国千千万万辅警中的一员。据不完全统计，我国目前有各类警务辅助人员400万人左右。他们穿着“警服”，往往干着和警察同样的工作；但在一些人眼里，他们不过是“临时工”，没有独立执法权，人员构成鱼龙混杂；而在他们自己看来，收入低待遇差，没有身份认同感，未来之路迷茫。
最新的政策是，今年1月中央审议通过的《关于规范公安机关警务辅助人员管理工作的意见》，其中明确了公安机关对警务辅助人员招聘、管理、履行职责、保障监督等内容。警务辅助人员的职业保障和管理模式，成为全面深化公安工作改革中绕不过的话题。
警力不足下的辅助力量
对于辅警，各地叫法不同。有的地方称“协警”或者“警辅”，以前也有地方称“联防队员”。
曹文玉所在的移动警务站周边人流量大，巡控任务繁重。从早上8点半开始，他们要进行几乎不间断的巡逻，一直到第二天早上8点半。之后回到派出所，曹文玉还需要对前一天24小时所发生的案件进行处理，晚上8点半下班。一轮值班下来，需要连续工作36个小时。
尽管工作强度大，但曹文玉觉得，在移动警务站的工作相对来讲已经很轻松了，“至少不用常年在外风吹日晒”。
“风吹日晒”的工作，内蒙古乌兰察布市的一线交通辅警刘飞已经干了11年。他的工作是开展公路巡逻，除了查处违法行为，还要帮助救助车辆。最辛苦的是冬天上路执法，在乌兰察布零下三四十摄氏度的风雪夜里，几乎每天都有受困的车辆和人员等待救援。刘飞需要一辆接一辆地推车，去年一个冬天下来，他冻伤了自己的脸。
曹文玉和刘飞都加入了一个“辅警协警大联盟”的聊天群。在这个有1300多名辅警成员的“联盟”里，大家并不经常谈论各自工作的辛苦，互相吐槽这种司空见惯的事情被认为“没有意义”。
“联盟”里的何晓华，是河北保定城关派出所的一名一线辅警。他告诉记者，在日常社会治安、防控、巡逻、交通指挥及配合缉毒、办案等工作中，都能看到辅警的身影，他们做的工作，往往不止于“辅助性”，其背后折射的现象是基层警力的不足。
据了解，国际上一般用每万人配备的警察人数衡量一国（地区）的居民生活安全程度。中国平均每万人配备13名警察，而韩国为30名，德国为40名。目前我国一些地方辅警人数已经超过了民警，在一些发达地区，民警与辅警的比例高达1:3。何晓华所在的基层派出所，辖区内常住人口6万多，所里的正式民警只有6名，辅警则有16名。
出警时，1名民警带三四名辅警，有时候则没有民警带领。“民警太少工作太多，他们干不过来，两个人办理三个案子都很正常。”何晓华说，“大城市还好一些，在县级公安机关以下，部分地区辅警就是和民警一样的存在。”
挥之不去的身份困惑
在辅警的聊天群里，和民警诸多的“不一样”被成员们提得最多，其中就包括辅警没有独立执法权。
一天下午，刘飞在查处交通违法行为时，对方司机看见了自己制服上的“XJ”（协警）标识后，立马提出要看刘飞的警官证。虽然认为对方是在存心挑毛病，但刘飞还是告诉他：“我就是辅警，没有警官证。我们执法都全过程录像，要是有异议，可以找上级部门。”谁知对方不依不饶，刘飞只好叫来了民警。
虽然这样的情况已经让刘飞习以为常，但消除不掉的是随之而来的尴尬感。很长一段时间里，刘飞执法时都没有底气。
“其实，辅警就是辅警，没有独立执法权是对的。但关键是这个身份太尴尬，做了好事是民警的，出了问题就是辅警的。”刘飞说。
社会对辅警价值的认同度不高，辅警协助民警执法过程中，受到个别群众奚落、嘲笑甚至侮辱的情况时有发生。有辅警颇为感伤地说:“‘打的就是你们辅警’这类话，不是没听过。”
曹文玉觉得，身份的模糊带来的另一个难题是，如果他们遇到暴力抗法，对方并不能认定为妨碍公务。曹文玉在一次执行巡逻任务时，发现一名男子涉嫌行骗，便上前对其检查。结果对方立即发动汽车逃离，将挂在车门上的曹文玉拖行了一公里，导致曹文玉腿部受伤、脑震荡，住院两周。“因为我是辅警，所以对方够不上妨碍公务，案件的侦破就受到了阻碍。”
难题不止于此。很多辅警表示，他们的工资、福利待遇都远低于正式民警。何晓华记得2003年刚做辅警时，一个月工资是200元，从2009年开始，工资涨到850元，一直拿到现在。“这个数差不多属于当地最低工资线，而且没有保险和住房公积金。”此外，许多辅警是与劳务派遣公司签订劳务派遣合同，面临着被辞退的随意性，这让他们感到没有保障，甚至发出“我们到底归谁管”的疑问。
期待改革中破解难题
事实上，我国的辅警制度从其诞生之日起，就成为备受争议的法律盲区。
2004年公安部曾发出通知，要求各地公安机关对聘用的协警、联防队员、治安员队伍进行专项清理，并要求在3年内全部清退。但这道命令似乎并没有彻底解决辅警问题。
2015中央审议通过的《关于全面深化公安改革若干重大问题的框架意见》中又提出规范警务辅助人员管理，说明我国辅警制度在不断完善。2016年1月通过了《关于规范公安机关警务辅助人员管理工作的意见》，这个意见尚未转化为法律法规。
但是，目前已有一些地方公安机关对此做出了探索。2012年7月，全国首个规范警务辅助人员管理的地方政府规章——《苏州市警务辅助人员管理办法》正式施行，明确辅警既不是临时工也不是志愿者，而是与公安机关签订长期工作合同、工作失误由公安机关承担法律责任的“警察助手”。
更让刘飞关注的是，改革为辅警人员在晋升渠道上打开了一扇窗。国家公务员局考试录用司司长盛桂英今年2月指出，今后，特别优秀的警务辅助人员可以正式入警。随后，浙江、广东等地先后出台政策，制定出具体招录方案。
“这肯定是好事。”刘飞说，“虽然还有待看到落实效果，但至少在打通职业‘天花板’上，让我们看到了曙光。”
