中国内地扩大对港澳服务业开放：可在广东设娱乐场所
中国内地对港澳服务业扩大开放的新一轮举措确定。
6月1日，中国政府网公布《国务院关于在内地对香港、澳门服务提供者暂时调整有关行政审批和准入特别管理措施的决定》（国发〔2016〕32号）。《决定》对香港、澳门服务提供者，在内地投资“关于内地在广东与香港、澳门基本实现服务贸易自由化的协议”（《协议》）中开放的服务贸易领域，其公司设立及变更的合同、章程审批改为备案管理，不再参照外商投资的相关审批规定。
此外，《决定》还对香港、澳门在内地投资服务业，作出一系列松绑举措，涉及行业包括电信、海运、办学、营业性演出、开办娱乐场所、展览，以及民用航空等。
为此，国务院暂停调整了多项相关法规，包括《外商投资电信企业管理规定》、《中华人民共和国国际海运条例》、《营业性演出管理条例》等。
行业观察人士告诉澎湃新闻（www.thepaper.cn），《决定》是将此前在广东省实施的对港澳服务业扩大开放的多项措施，适用范围扩展到了全国。
2015年3月，国务院发布了《国务院关于在广东省对香港、澳门服务提供者暂时调整有关行政审批和准入特别管理措施的决定》（国发〔2015〕12号），该文件决定在广东省，在电信、海运、办学、营业性演出、征信、游戏设备销售、民用航空等7个行业，对港澳服务提供者扩大开放。
今天公布的《决定》，即日起生效，而2015版的12号文则同时废止。
至于2015年发布的12号文中，有关在广东省内，对港澳投资者扩大开放的征信业，以及电子游戏设备销售等相关规定，由于相关领域此前已经向海外投资者开放，所以未在《决定》中保留。
值得一提的是，相比12号文，《决定》中还新涉了两个扩大开放行业，分别是营业性演出，以及会展。
在营业性演出方面，《决定》提出，在内地对香港、澳门服务提供者暂时调整实施相关准入特别管理措施，允许其在内地投资设立地方控股的合资文艺表演团体；香港、澳门永久性居民中的中国公民无需经过外资审批，可以在内地设立个体工商户，从事个体演出经纪人业务；具体办法由国务院文化主管部门会同国务院有关部门制定。
在会展方面，《决定》提出，在内地对香港、澳门服务提供者暂时调整实施相关行政审批和准入特别管理措施，允许其在内地从事《协议》规定的会议和展览服务；具体管理办法由国务院商务主管部门制定。
需要指出的是，内地对港澳投资者扩大开放娱乐场所经营这块，《决定》仍将其适用范围设定为广东省。
按照《决定》，在广东省对香港、澳门服务提供者暂时调整实施相关准入特别管理措施，允许其在广东省独资设立娱乐场所；具体管理办法由广东省人民政府制定。
现行的《娱乐场所管理条例》第六条规定：外国投资者可以与中国投资者依法设立中外合资经营、中外合作经营的娱乐场所，不得设立外商独资经营的娱乐场所。
