　　昨日，巧家县保姆投毒冤案当事人钱仁凤向省高院提起国家赔偿，对其蒙冤入狱的13年10个月，共计申请国家赔偿955万余元。

　　钱仁凤的代理律师杨名跨和杨柱介绍，具体索赔金额分别为：侵犯人身自由国家赔偿金584万余元；精神损害抚慰金204万余元；近14年申冤费用166万元。

　　值得注意的是，在侵犯人身自由国家赔偿金方面，申请人提出应按每日24小时计算赔偿金，而非《国家赔偿法》所规定的以每日工作8小时计算。

　　杨柱说，以前国家赔偿标准是每天217元，今年5月16日出台新的标准是每天242元。杨名跨称，在钱仁凤失去自由的5050天中，除法定 工作日3400天外，还包括周末1440天、法定节假日150天、法定公休日60天。法定工作日除8小时按工资标准索赔外，另外16小时按加班计算，周 末、节假日、公休日按正常工资标准的2倍、3倍、3倍计算。因而，5项算下来，索赔合计584万余元。（春城晚报 记者熊波）
