US Court: operator-operator free access to a user's location information, privacy-IT information

On June 1, according to foreign media reports, a United States appeals court Tuesday ruled that law enforcement officials obtain user location data from operators without the legal license file.

It is reported that the United States Third Circuit Court of appeals in Richmond, Virginia before making this decision. The ruling was based on a legal basis, and that such information has been shared by third parties. Court eventually was adopted by 12 votes to 3 votes against the ruling.

Controversy about the ruling harks back to the 2011 Baltimore armed insurrection. Cracked the case, police drawn from operators Sprint 221 days of telephone data, including 29,000 data records. Two people were eventually convicted.

Judge daianna·Mozi (Diana Motz) believes that this decision did not violate the Constitution, because mobile phone users full knowledge of their location data is shared with the operators. 6月1日消息,据国外媒体报道,一美国上诉法庭当地时间周二裁定,执法人员从运营商处获取用户位置数据无需取得法律许可文件。

据悉,美国弗吉尼亚州里士满第四上诉巡回法院日前作出了此项裁定。该裁定基于一个法律依据,即这些信息已经被第三方共享。最终法庭以12票赞同3票反对通过了该裁定。

关于该裁定的争议最早可以追溯到2011年的巴尔的摩武装暴动。为破获这起案件,警察从运营商Sprint处提取了为期221天的电话数据,其中包括了2.9万条位置数据记录。最终两人被定罪。

法官戴安娜·莫兹(Diana Motz)认为,这一裁定并不违反宪法规定,因为手机用户完全知晓其位置数据与运营商共享。莫兹指出,“每一个人在户外收到手机信号,或是在走进电梯时收到关于无服务的警告,表明用户在一定程度上知晓自己的位置被共享的问题。”

然而一些人对此持有异议。法官詹姆斯·永利(James Wynn)反驳称,“手机用户并不是非常主动地提交位置信息,因此位置数据的相关裁定不应当因第三方共享理论而成立。”
