　　2013年8月，做蔬菜收购生意的福建云霄人陈建忠，因涉生产、销售伪劣产品（假烟）罪在北京某机场被捕。公安侦查终结后移送检方起诉，但在一审开庭中，另两名同案人在法庭上却指称陈建忠“对不上号”，非他们认识的“陈建忠”；被提起公诉的陈建忠辩称，自己有案发时不在案发地的新证据。之后，检方以“证据发生重大变化为由”撤诉。在离开看守所之前，陈建忠被关押了17个月共540天。

　　今年2月23日，陈建忠向广东潮州市饶平县检察院申请国家赔偿。随后饶平县检察院决定立案审查，并出具《刑事赔偿立案通知书》。在申请书中陈建忠提出了三点要求：一是检察院在侵权行为影响的范围内为他消除影响，恢复名誉，赔礼道歉；二是追究饶平县公安局办案人员刑讯逼供的刑事责任和饶平县检察院办案人员的错案责任；三是赔偿人身自由赔偿金、精神损害抚慰金、经济损失及律师费交通费等共计1758648.8元。

　　记者获悉，饶平县检察院最后作出的《国家赔偿决定书》，对侵犯陈建忠的人身自由按照2014年全国职工平均工资标准219.72元×540元/天=118648.8元赔付，另外赔偿精神损害抚慰金3万元，但驳回了其他赔偿请求。最终，陈建忠获赔约14.86万元国家赔偿。不过陈建忠儿子陈天式补充称，检方还对其父作出了22万元出于人道主义的生活困难补助，总计收到36万元款项。

　　当事人陈建忠表示，对检方工作人员登门道歉的处理方式满意，从此他将开启新的生活。记者梳理发现，在近年多起冤案的事后赔偿中，陈建忠获得的额外生活困难补助，属国内首起案例。
