北京医疗纠纷诉讼量7年增近2.4倍
新京报快讯(记者王硕)据最新发布的《北京社会治理发展报告(2015-2016)》称，北京市医疗纠纷诉讼数量7年来持续增加，医患关系仍呈现紧张状态。近日，该报告由市社会科学院、社会科学文献出版社共同发布。
报告还建议，对于一部分冲突激烈、赔偿额度较大的医患纠纷，可以试行由第三方“强制性调解”，不允许医患双方自行协商和解。
2014年现场制止“医闹”事件263次
报告中介绍，北京医疗机构云集，其中优质医疗资源更是相对集中，每日接纳的患者也居于全国之首。根据北京市公共卫生信息中心2015年6月公布的数据，截至2014年末，北京市医疗机构达10107家，其中三级医疗机构89家，居于全国之首。全市卫生人员数(包含15家驻京部队医院)达30.4万人，人数比2013年上升了3.7%。2014年，全市医疗机构诊疗22967.1万人次，较2013年增加1084.6万人次，增长5%。诊疗人数增幅明显高于卫生人员数量增幅，医师工作负荷不断加大。2014年，全市医疗机构医师日均担负诊疗11.1人次和住院1.1床日，与2013年比医师日均担负诊疗人次增加0.3人次。
在诊疗人数不断增加、医师负荷不断增大的背景下，医患纠纷的发生率也呈上升趋势。近年来，北京市医疗纠纷诉讼数量逐年增加，进入诉讼程序的医疗纠纷也逐年上升。2007年，北京市法院一审受理的医疗纠纷案件仅468件，2008年715件，2009年885件，2010年1004件，2011年1040件，2012年1097件，2013年这一数量增长到1152件，7年间增长近2.4倍。
调查显示，在众多医患纠纷中，不乏“医闹”现象，甚至有扬言伤害乃至实施伤害医务人员的极端案件。据统计，2014年北京市有关部门已集中解决涉医突出问题101起，现场制止“医闹”事件263次，依法及时处理扰乱医疗秩序案件151件。可见医疗纠纷的形势依然严峻，医疗纠纷频发的社会问题值得高度关注。
建议部分医患纠纷试行强制性调解
如何处理日益增多的医疗纠纷?如何避免因医患冲突升级给双方带来伤害?
报告认为，北京市医疗纠纷人民调解委员会设立近5年来，调解医患纠纷成绩较为显著。从2011年设立至2015年11月30日，医调委已受理医疗纠纷7949件，调解率100%，成功率95.78%。调解结案7519件，其中疑难复杂纠纷2127件，涉及当事人31796人，实际赔偿金额4.2亿余元。现场紧急调解纠纷328起，成功引导75%以上的当事人接受并申请进行调解。
报告指出，尽管医患纠纷专业调解制度取得较好成绩，但仍然有一些表层及深层矛盾需要解决。报告建议，对于医患纠纷调解，首先要确保中立，在此基础上不断提升医患纠纷专业调解的专业性，强化程序的参与与透明，促进调解的公信力。
此外，报告建议，对于一部分冲突激烈、赔偿额度较大的医患纠纷，可试行强制性调解。即对于此类医患纠纷，不允许医患双方自行协商和解，而必须由医调委等中立第三方进行先行调解，以隔离冲突双方，减少不必要的非理性对抗。为了探索该程序的可行性，可在部分地区或医院试行。
