检察机关认为存在犯罪事实

在执法过程中，如果出现了执法对象死亡的情况，应该启动什么样的程序呢？中国政法大学教授顾永忠表示，办案机关执法人员应当向检察机关报告，应当保护现场，应当通知当事人的家属。
至于家属在了解情况后有何权利，顾永忠称家属有权了解案发的过程、了解雷洋死亡的原因，有权认为执法人员涉嫌违法犯罪，有权向公安机关或者检察机关提出控告或者报案，要求查处这些办案人员的责任。

雷洋案尸检必须由第三方进行
要想了解雷洋的真实死因，需要做尸检。该如何尸检？由哪个机构进行尸检？
对此，顾永忠表示，被害人的家属有权选择进行尸检的主体，有权参与尸检的过程，而且也可以委托律师协助参与尸检过程。
根据《全国人民代表大会常务委员会关于司法鉴定管理问题的决定》第七条规定，人民法院和司法行政部门不得设立鉴定机构。除了法院没有内设鉴定机构以外，公安机关、检察机关都有内设司法鉴定机构。而在雷洋案中，因为雷洋是和民警在一起时死亡，所以公安机关内设的法医鉴定机构应当回避，最终检察机关决定，委托第三方鉴定机构进行尸检，检察机关的法医对第三方鉴定机构的尸检过程和结果进行监督。
尸检时死者家属等要在场
中国法医学会会员副主任法医师李秀林表示，检察院委托尸检之后，法医会要求办案单位在场，死者的家属在场，相关的见证人在场，就是第三方要在场。 在这种情况下，法医才能开展工作。
根据《人民检察院刑事诉讼规则》第二百一十二条规定，人民检察院解剖死因不明的尸体，应当通知死者家属到场，并让其在解剖通知书上签名或者盖章。所以，在第三方鉴定机构检验过程中，除了检察机关会派人监督，家属也会到场，另外由于检验涉及技术性很强的鉴定问题，所以也可以申请有专门知识的人到场监督。
尸检主要进行5类检验
尸检具体都要检验什么？据了解，检验的目的在于确定死亡原因，一般来说，鉴定机构会做尸表检验、解剖检验、毒物分析检验、酒精检验、病理学检验等5类检验。检验是一个严格的精细化活动，从表面的微小状况到穿着衣物的痕迹都会被记录在案。整个过程需要一个月左右。
虽然时间很长，但是整个检验过程都会有影像记录，根据《人民检察院法医工作细则》第十四条规定，尸检应当进行照相、录音录像。照相和录音录像应当由专业技术人员进行。未经办案部门批准，禁止其他人员照相和录音录像。如果家属对这份检验报告有异议，可以补充鉴定或者重新鉴定。
目前，雷洋尸检还在病理检验阶段，结果尚需等待。
