今年4月,北京的王女士想要安装宽带,小区物业告知她只能安装中国电信宽带,而不能安装其他公司宽带,因为“中国电信当时为小区布了光纤,如果其他公司宽带想要进入,还需要支付给中国电信费用,所以暂时只能装中国电信的宽带”。

无奈之下,王女士被领到了小区附近的一个中国电信营业厅,并办理了包年宽带套餐,总共花费1410元。

5月,王女士去中关村一家中国电信营业厅办理手机业务时,业务员告诉王女士,按照其月消费超200元的标准,其手机号可以免费绑定使用中国电信的宽带。这让王女士非常吃惊,自己小区附近的电信营业厅并未告知她可以享受这项优惠,导致她白花了1410元。

“后来,中关村中国电信营业厅的工作人员帮我查询后,发现我办理宽带的营业厅并非中国电信正规营业厅,而是合作厅。”王女士告诉记者,自己此前并不知道有合作厅和正规厅之分,更不知道二者的优惠政策还不相同。

中关村中国电信营业厅工作人员告诉王女士,这种情况很可能是合作厅为了赚钱,故意隐瞒该项优惠,因为合作厅的宽带业务是被中国电信外包出去的,可以说合作厅属于“私人所有”,其为了盈利,就可能故意不提供给消费者本该享有的优惠。

当天,王女士即拨打了中国电信客服电话进行投诉,当晚中国电信工作人员致电王女士,告知她遇到的问题“无法处理”,原因是合作厅和中国电信属于两套系统,合作厅办理的业务没有办法干预。

之后,经过王女士不断投诉,上述中国电信合作厅工作人员致电王女士,称可以为其注销宽带,不过需要收取330元初装费。

“但是中关村的中国电信营业厅告诉我,这种情况按照优惠政策,是可以直接绑定手机号,且不用收取初装费的,而且不需要注销宽带号,只需要将其解绑,再由正规厅将宽带与手机绑定在一起,便可免费使用宽带。”王女士说。

合作厅给王女士的解释则是:“必须注销宽带号,才可以退钱,解绑业务没有办法办理,而且王女士要想绑定手机号,在其营业厅是不予办理的。”这家合作厅还称,这是由于中国电信城区和郊区的优惠政策不同。

王女士随后又致电中国电信客服,被告知其在北京城区郊区的优惠政策都是一样的,并未有差异。

无奈之下,王女士只好签署了注销业务,但是由于各种推诿,王女士的宽带至今未能绑定到其手机号并正式开通,截至记者发稿前,中国电信仍未给出一个好的解决方案,并为其恢复上网。

记者在调查中发现,像王女士这样的情况,目前大量存在,不仅是在北京地区,河北、广东、河南等地不少用户也向《经济参考报》反映了和王女士相似的经历。此外,除中国电信外,其他电信运营商和宽带接入服务商同样存在类似问题。

有运营商人士告诉《经济参考报》,上述合作厅和运营商属合作关系,以一定的价格购买运营商的各项服务后,再转卖给用户,其合作方式和现在的虚拟运营商相似。运营商和合作厅签署的协议一般并不规定各类服务专卖的价格,合作厅的运营也不受运营商约束,因此就会出现上述合作厅高价按自己制定的价格销售服务的情况。

“目前宽带接入市场竞争非常激烈,除了三大运营商外,还有多家宽带接入商和广电系统企业参与。为了获得用户,各家企业均在过去几年大大降低了服务费用。”上述运营商人士认为,王女士之所以遇到了高价宽带问题,其原因可能是上述合作厅和小区物业串通,人为造成小区宽带垄断。

物业坐收高额入场费 小区宽带被高价垄断

记者在调查中发现,在宽带垄断的小区,用户所花费用往往比宽带自由竞争的小区要高不少。

家住北京市朝阳区管庄康泉小区的张先生告诉记者,小区去年交房后,自己开始装修,在安装宽带时就遭遇到了高价垄断问题。他所选择的服务每年1610元,是一路之隔的远洋新悦小区同一运营商同等服务的宽带价格的两倍。

张先生在询问物业后得知,康泉小区内只有一家电信运营商的代理商提供宽带接入服务,其他宽带服务商均不能进入。张先生随后拨打这家运营商电话反映问题,但这家运营商客服称,因为是代理商提供服务,所以运营商无法直接解决。

据远洋新悦小区一家宽带服务商社区经理介绍,康泉小区的宽带接入服务是运营商的代理商做的,不是运营商直营,所以不但宽带价格要高于运营商直营价格,而且运营商的各类优惠活动,康泉小区的用户也没办法参加。

记者调查发现,不管何种方式,只要小区被一家宽带接入商所垄断,其宽带价格就远远高于其他小区。记者根据用户提供的线索,走访了北京市多个只有单一宽带接入商的小区,发现其价格要比其他小区高出50%到100%。在朝阳区朝阳路附近的一家小区,记者发现这里的中国联通合作厅提供的20M宽带服务费一年高达1800元,而在附近的小区,同样是20M的中国联通宽带服务一年仅仅只要760元。

记者向这家小区的物业人员询问,是否存在小区宽带垄断问题时,该小区物业人员称“并不存在”。至于为什么小区只有一家宽带服务商,工作人员则表示“不清楚”、“你得问其他商家”。

一家民营宽带服务商的社区工作人员告诉记者,他们公司从2014年开始就想进入该小区,但被物业要求缴纳高额的“入场费”。“我们算了一下成本,就算这个小区的所有用户都用我们的宽带,这笔入场费也可能让我们亏损。”该工作人员说,公司最终放弃了进入这个小区。

记者随后就宽带垄断等问题致电三大运营商,三大运营商表示,绝不允许宽带垄断的情况出现,更不会纵容工作人员和小区物业进行串通。一旦用户发现类似问题,请第一时间致电公司客服,三大运营商将尽快予以处理。

但三大运营商方面也坦言,目前只能对公司的直营营业厅进行严格管理,对部分代理商和合作厅的行为却无法进行约束。不过,运营商方面也已经注意到了用户的反映,将研究制定与代理商和合作厅的全新合作模式,以保证用户利益不受损害。

运营商约束力有限用户维权得向工商局举报

事实上,国家对禁止宽带垄断早有明文规定:由国家工信部、住建部共同出台的《住宅区和住宅建筑内光纤到户通信设施工程设计规范》、《住宅区和住宅建筑内光纤到户通信设施工程施工及验收规范》两项国家标准早在2013年4月1日起就开始正式实施。其中规定,住宅建设单位、物业服务企业不得与任何企业签订垄断性协议,不得限制各电信运营企业平等接入和使用,不得以任何方式限制用户选择权。

尽管有明确的法规对宽带垄断加以禁止,但这一现象却屡禁不止。多数用户反映,其原因是用户不知该如何维权,这使得大量小区物业和垄断宽带服务商肆无忌惮,更加明目张胆地高价销售宽带服务。

记者在调查中发现,在遭遇小区宽带垄断情况时,多数用户都会直接拨打运营商客服寻求帮助,但出于合同等原因,运营商往往无法约束和矫正相关代理商和合作厅的行为,这就使用户认为,运营商对此也无能为力,再加上需要使用宽带,也就只能接受高价的垄断宽带了。

其实,遇到类似问题,用户并非毫无办法。记者查阅工信部相关规定后发现,在遇到小区宽带垄断时,用户可向当地工商局和工信部门进行举报,一旦情况属实,相关部门就会对违规的小区和宽带服务商进行查处。此外,用户还可以向当地消费维权机构进行举报,维权机构也会将情况反映给当地的工商局和工信部门,进一步帮助用户维权,并打击违规行为。
