京东如逾期不履行本行政处罚决定，北京市发改委可依据相关规定申请人民法院强制执行。京东如果对处罚决定不服，可在规定时间内，向北京市人民政府或者国家发展和改革委员会提出行政复议申请。行政复议期间，本处罚决定不停止执行。

京东接受处罚称无主观故意
昨天下午，京东相关负责人表示，京东接受北京市发改委的相关处罚。此次涉及的大部分违规行为集中在价格标注错误。该公司商品标价行为中确实出现了原价标注错误、折扣计算不准确等价格标注方面的问题，虽然不存在主观故意，但会给消费者造成误解。对此，京东表示致歉，并将以此为契机进一步加强内部管理，包括加大力度强化各项价格标注管理措施，加强价格标注内部培训，强化采销人员对《价格法》及配套规定的准确理解，改进标价系统等手段来尽可能提高价格标注的规范化。

严重欺诈可被吊销执照
北京八都律师事务所主任王西铭律师认为，如果网站借活动提高商品标价，再进行打折销售，诱导消费者消费，网站的这种行为应该属于欺诈。同时，王西铭认为，网站所出售的商品价格应该按照市场规律波动，但是价格波动的范围应该在市场和法律的规定范围之内，否则可能存在不正当竞争现象。
熊志律师事务所姜健律师也表示，我国相关法律规定，经营者利用虚假的或者使人误解的价格手段，诱骗消费者或者其他经营者与其进行交易，属于不正当竞争行为。典型的如虚假降价、谎称降价而实际上没有降价。对于此种违法情形，政府价格主管部门可责令改正，没收违法所得，并处违法所得5倍以下的罚款；没有违法所得的，处5万元以上50万元以下的罚款；情节严重的，责令停业整顿，或者由工商行政管理机关吊销营业执照。
