新京报快讯（记者李丹丹）备受关注的《婴幼儿配方乳粉产品配方注册管理办法》8日对外公布。《办法》明确我国境内生产销售和进口的婴幼儿配方乳粉产品配方均实行注册管理，这意味着我国对婴幼儿奶粉的配方管理已经上升到药品监管的级别。
《婴幼儿配方乳粉产品配方注册管理办法》将于今年10月1日起实施。
设立注册门槛
实行配方注册管理 限定申请人资质条件
配方注册制被奶粉行业称为“史上最严奶粉新政”。
在2015年4月24日修订通过的《中华人民共和国食品安全法》中规定，婴幼儿配方乳粉的产品配方应当经国务院食品药品监督管理部门注册。注册时，应当提交配方研发报告和其他表明配方科学性、安全性的材料。不得以分装方式生产婴幼儿配方乳粉，同一企业不得用同一配方生产不同品牌的婴幼儿配方乳粉。
国家食药监总局副局长滕佳材表示，去年在食品安全法修订草案审议过程中，食药监总局明确提出对婴幼儿配方乳粉的产品配方实行注册管理。总局先后召开了专家论证会、地方监管部门座谈会、企业听证会，充分听取了企业和专家对婴幼儿配方乳粉的配方实行注册管理合法性、必要性和合理性的意见与建议。
他表示，经报国务院同意，建议全国人大在新食品安全法中增加婴幼儿配方食品的专门规定，对婴幼儿配方乳粉产品配方实行注册管理。考虑到这一规定有利于保证这类特殊食品的安全，全国人大常委会采纳了这一建议。

只有具备相应的研发能力、生产能力、检验能力，符合粉状婴幼儿配方食品良好生产规范要求，实施危害分析与关键控制点体系，对出厂产品按照有关法律法规和婴幼儿配方乳粉食品安全国家标准规定的项目实施逐批检验的婴幼儿配方乳粉生产企业才能申请产品配方注册。
限制配方数量
乳企原则上不得超过9种产品配方
我国婴幼儿配方乳粉市场需求大、行业发展迅速，但是发展时间短。目前我国103家婴幼儿配方乳粉生产企业共有2000个配方，个别企业甚至有180余个配方。
婴幼儿配方乳粉配方过多、过滥，配方制定随意、更换频繁等问题突出，存在一定质量安全风险隐患，造成消费者选择困难。
国家食药监总局副局长滕佳材表示，近年来，我国婴幼儿配方乳粉的质量安全水平总体稳定向好，国民对国产奶粉的消费信心正在逐步恢复。但影响婴幼儿配方乳粉质量安全的因素仍然存在。
他说，企业在产品质量控制体系方面还需要进一步加强之外，其中还有一个很重要的因素就是企业盲目地将配方作为市场营销的手段，以致造成婴幼儿配方乳粉的产品配方过多、过滥、配方制定缺乏充分的研究论证，配方之间的区分缺少科学证实，品牌与配方的混乱造成消费者选择困难，生产过程中频繁更换配方对产品质量安全造成隐患等问题。
国内许多企业采取“类似配方、不同品牌、加大宣传、扩大市场”的销售策略，即简单把一个配方的组成成分及含量略作改变形成多个“新配方”，生产不同产品不同品牌，在不同渠道销售，通过夸大宣传误导消费者购买，造成消费者选择困难。
《办法》明确，同一企业申请注册两个以上同年龄段产品配方时，产品配方之间应当有明显差异，并经科学证实。
《办法》要求每个企业原则上不得超过3个配方系列9种产品配方，旨在通过限制企业配方数，减少企业恶意竞争，树立优质国产品牌。此外，《办法》允许同一集团公司全资子公司可使用集团内另一全资子公司已经注册的产品配方。
规范标签标识
不得暗示“益智、增加抵抗力、免疫力”
《办法》要求申请人申请注册时一并提交标签和说明书稿及标签、说明书中声称的说明、证明材料，并对标签和说明表述要求作出细致规定。
如，对产品中声称生乳、原料乳粉作原料来源的，要求如实标明具体来源地或者来源国，不允许使用“进口奶源”“源自国外牧场”“生态牧场”“进口原料”等模糊信息。
