2016年5月27日，贵州省铜仁市中级人民法院一审以贪污罪判处张叶有期徒刑三年零六个月，并处罚金40万元。
1 崇尚奢靡，违反中央八项规定精神
2012年，铜仁市投资促进局先后在广州、杭州、重庆、青岛、长沙等地设立招商分局，明确分局为财政全额预算管理的副县级事业单位，工作经费独立使用、独立核算、自行做账，并面向各行政、事业单位公开招考各分局局长。
时年10月，是张叶人生的拐点。
1981年出生于沿河县大山深处、拥有硕士研究生文凭、尚未成婚的张叶，以优异的成绩从众多竞争者中脱颖而出，先后被任命为铜仁市投资促进局驻青岛、长沙分局的局长，成为一名年轻的副县级领导干部。
副县级的成功“跨栏”，让张叶信心爆棚。
青岛，又被誉为“东方瑞士”。来到青岛，繁华的商业，形形色色的老板，让张叶感到了自己的欠缺。
然而，她并没有把精力花在苦练内功、研究招商工作的内在规律上，而是急于把自己包装得“高、大、上”，认为这样才能“适应”新的工作岗位。
于是，她顶风违反中央八项规定精神，经常出入高档会所、酒楼“洽谈”合作，沉醉其中，不能自拔。
就这样，她逐渐被城市的繁华迷住了双眼，迷失了方向。
2 贪图虚荣，违反廉洁纪律
“对商务谈判的无限迷恋使我对商务礼仪、中西方用餐习惯、中国茶文化、咖啡等做了系统的学习和研究。”落马后，张叶忏悔说，在虚荣心的驱使下，她经常学习 功夫茶的泡制，请专业的教师分享传授茶文化、咖啡文化和红酒文化，这一切不为别的，只为搭上话，害怕别人说她不懂行，没有文化。
据张叶自述：“为了让客商放心，坐着舒心，我自己也觉得有面子，就买奥迪A4L。”很明显，车子大大超标。“认为自己好歹也是一个招商局长，为了招商局长那点面子和虚荣心，决定购房。”购房本来是一件正常的事，但用13万元的公款支付购房款，就不正常了。
在领导面前，张叶以拍胸脯的方式扮演着一个“好下属”、“好孩子”的角色。然而，当得知市委、市政府2013年10月要考核驻地招商工作时，她彻底慌了手脚。人没有认识几个，来铜仁投资的企业家一个也没对接上。几夜未眠后，她决定去北京“赌一把”。
张叶说：“到了北京，认为对方重要，就下‘赌注’，甚至直接以咖啡费、商务费等形式把现金送给对方。”
急功近利，外强中干；底气不足，方寸大乱。当2014年4月，她接到市政府5月举行长沙推介会的消息后，不是努力地分析形势，争取领导支持，而是采取了极其错误的方法开展工作。
据她自述：“生怕人数、规模达不到，被领导打板子，就提着茅台酒、高档烟等礼品去求企业家来参加推介会，有的还送上了现金等所谓的商务佣金。”
但是，张叶声称送出去的那些礼金礼物到底落到何处了呢？
法庭上，公诉人出示了奔波各地收集的证人证言：有的查无此人，有的称没收到过张叶送的礼品礼金，甚至有人称根本就不认识张叶。面对这些证据，张叶一次又一 次失声痛哭。张叶的领导、同事也称不知道张叶给人送礼的情况，并证实招商分局在工作开展中并无送人礼品、礼金的规定。张叶本人始终无法说明被其借支的公款 去向，更不能证明公款作为公务支出的性质。
3 公私不分，侵吞公款
公私要分明，公款不能私用，这是常识。然而，这些常识，在张叶面前形同虚设。
张叶把单位账户变成个人账户使用，故意将公款与私款混同使用，把公款当成个人的钱袋子，随取随用，单位的所有支出也变成“我说了算”。
2014年1月，张叶以要拜年为由，直接让财务人员取现金10万元交给自己，她把该10万元据为己有。同年2月，张叶用该笔公款中的2万元支付了自己购买商品房的定金，其余8万元被其作为春节期间的个人消费支出。
经查，2012年10月至2014年10月，张叶在先后担任铜仁市投资促进局驻青岛、长沙招商分局局长期间，共侵吞公款47万多元，其中13万元被其用于个人购房，34万多元被其用于个人其他支出。
公款私用必然留下蛛丝马迹。为掩盖事实，张叶想了一个自认为“高明”的办法——先后4次用他人身份证虚开烟酒茶等发票，到单位报销冲账。其中金额最大的一笔近23万元。
●忏悔录
价值观出问题，我迷失了自己
（担任市投资促进局驻青岛分局局长后）我主要负责在环渤海湾区域的招商引资工作。当我满怀信心走进北京，去一单位拜访争取援助的时候，人家看着我两手空空 往门口一站，只给了我一句：“请找你们××主任。”就再也不回头了。我下楼提上两瓶茅台再次走进办公室的时候，一切都发生了变化：又是电话帮我联系论坛的 时间、地点、门票、邀请函，又是联系商会对接的副秘书长，等等。我的思想第一次受到致命的冲击：我也走上了一条俗得不能再俗的路。第二天，在见两位朋友 时，我说了昨日无助的举动，被他们批评了，他们说那就是“游戏规则”，一切都是以钱办事，看钱办事。在接下来的两天中，请人喝茶喝咖啡就成了常态，在送别 人好处费后得到的服务和帮助中，让我对自己最初的理解“朋友是相互帮助的，不计回报的”有些动摇，原来“天下真的没有免费的午餐”。这也就是我后来不断地 请人吃喝，送人钱财的起因。

2013年2月，北京一老领导介绍9个客商来铜仁考察，我当时用一辆8万多（我们一直租的汽车）的车和一辆10万多的车机场接送，从东边到西边的考察我随 时陪同，小心翼翼地服务着。可人家回到北京后，向老领导反映车子质量太差，山路太危险，生命安全无法保障等，我被老领导批评了，说我不会办事。于是为了让 客商放心，坐着舒心，我自己也觉得有面子，就买奥迪车……为了招商局长那点面子和虚荣心，所谓的“尊严”占据了全部的思想。俗话说，人的潜能都是被挖掘出 来的，在今天我看来，我的虚荣心就是这样被“开发”出来的。
2013年4月后，从北方到南方工作，不管走到哪个企业家的办公室，人家都摆着功夫茶具，也泡着功夫茶与我们交谈、分享。有的客商喜欢喝红酒，我都会琢 磨。所以我就经常学习功夫茶的泡制，请专业的教师分享传授茶文化、咖啡文化和红酒文化，这一切不为别的，只为搭上话。从另一方面也是一种虚荣心驱使的表 现。后来，不管在铜仁还是长沙都是以送茶、品茶来沟通，害怕别人说我不懂行，没有文化。通过北京的关系联系各省市的朋友，通过一些高校的培训机构宣传推 介，无外乎体现一个“高端展示”的虚荣名声罢了；借助一些政府官员，对接外国企业家走进铜仁，参加几次外方的邀请洽谈，无外乎赚到一个“分局招商不仅面向 国内，也面向国际”的好评罢了，所有这些，都是我自己价值观出现了问题，在浮华时代忘记了青春的庄重承诺，忘记了“我是谁”，一出门就迷失了方向迷失了自 我。（摘自张叶忏悔书）
