  近一段时期以来,欧盟方面反对承认中国“市场经济地位”的声音又有所抬头。而这一问题的起源,是中国2001年“入世”时签署的《中国加入WTO议定书》(简称《加入议定书》)。


  根据相关条款,WTO成员方将中国视为“非市场经济国家”,对中国实行“特殊保障措施”和特殊的反倾销、反补贴政策。这也成为长期困扰中国企业的一大难题。然而按照《加入议定书》规定,“非市场经济国家”相关条款应于2016年12月11日终止。


  “用法律专业术语讲,这个条款叫作‘落日条款’。也就是说,根据协议,无论发生什么情况,到2016年12月11日,这个条款都要自动终止。”在6月13日上午与默克尔的会谈中,李克强郑重说,“我是学法律的,请你理解,我不能说违背法律原则的话。我们需要在国际社会中尊重国际法、国际规则和由此制定的商业规则,这样才能使我们之间的合作在稳定的轨道上前进。”


  “如果我们现在对这个条款还需要重新谈判,那我们是不是还要重新谈判关于中国加入WTO的问题?”李克强的反问道。

  会谈结束后,两位总理共见记者时,中国和德国两位记者的提问同样聚焦在这一议题。李克强在回答中重申,中国是不是市场经济国家,这由中国的国情决定。中国推进市场化改革所取得的成就也已为世界公认。但履行《加入议定书》第15条承诺义务,包括中欧贸易摩擦,都是不同层面的问题,应该分开讨论。


  “我和默克尔总理有一个共同认识,就是不能让我们之间的分歧‘失控’,更没有必要把一些贸易纠纷扩大化、复杂化。贸易摩擦在中德关系中只占很小一部分。”讲到这里,李克强伸出右手的大拇指和食指,摆出了一个“很小”的手势,“我们可以坦诚相待、相向而行,不断凝聚共识,妥善解决摩擦,扩大我们的共同利益。”


  他随即强调,中国不希望打贸易战,因为在世界经济复苏乏力的情况下,贸易战“对谁都不利”。


  德国总理默克尔在回答两国记者提问时明确表态:“我代表德方重申,我们很清楚记得当年作出的承诺,不会动摇。如果议定书第15条相关内容不能按时终止,对谁都没有好处。”


  默克尔表示,欧盟委员会已经认清了自己的义务,正在努力提出解决方案。双方将在专业层面开展进一步会谈,找到符合WTO规则的解决方案。


  她说:“德国愿推动欧盟委员会同中方加紧磋商,于年内取得结果。”
