中国外交部：过境通行和无害通过不可混为一谈

　　中新社北京6月17日电 (叶秋曈)针对日方就中国军舰日前通过日本吐噶喇海峡一事表态，中国外交部发言人华春莹在17日的例行记者会上答记者问时表示，中国军舰通过吐噶喇海峡是根据《联合国海洋法公约》在用于国际航行的领海海峡行使过境通行权，其与船舶在领海中享有的无害通过权不可以混为一谈。

　　有记者问，中国军舰“侵入”日本领海，之前中方曾解释说该海峡是用于国际航行的领海海峡。但今天日方表示该海峡并不用于国际航行。中方对此有何回应？

　　华春莹表示，对于这个问题，首先应纠正两点：第一，中国军舰不存在“侵入”日本领海的情况；第二，建议有关媒体和有关政府人士表态之前应好好学习和研究国际法。

　　她指出，根据《联合国海洋法公约》及其有关规定，吐噶喇海峡是用于国际航行的领海海峡。任何船只在经过用于国际航行的领海海峡行使过境通行权时都无需事先征得有关国家同意。中国军舰通过该海峡是根据《公约》在行使过境通行权。值得注意的一个事实是，船舶在用于国际航行的海峡中享有的过境通行权与船舶在领海中享有的无害通过权不可以混为一谈。
