正在遭遇出借人威胁“要公布裸照”的“裸持”大学生林晓（化名）告诉北青报记者，今年2月，因为想要创业开网店，她开始接触网络借贷，但她能借到的都是30%周利率的高利贷。林晓还不起，只能再借钱还前债。为了能借到更多钱，林晓同意了“裸持”借贷，她手持身份证拍摄了几张裸照和一段视频。对方核实信息后，借给了她5000元，于是林晓的噩梦开始了。

北青报记者随机添加了几名裸照出售者，通过认证后，其中一名出售者报价“1元”，记者支付后，对方分享了3张裸照和两段视频，并表示这些裸照资源“都是群里的”，暂时没有更新。记者询问能否进群，对方称“现在不让加”，近期“消息紧”，因为担心“有记者入群搜资料”。
同时，北青报记者添加的另一名出售者要求支付20元，称有多张“裸持”照片和多段视频，可以一次性通过邮箱发送给记者。为了证明自己手上有“裸持”资源，对方在聊天页面发送了4张未作处理的“裸持”女大学生照片，每张照片均为年轻女性手持身份证拍摄，照片中能清晰看出身份证上的姓名、出生日期、地址和身份证号。记者随后支付20元，接收到对方发送的64张裸照及视频。
接收到的这些卖家自称为“裸持”女大学生的照片中，有19张照片显示为年轻女性手持身份证拍摄，且这19张照片中有17张可以清晰显示身份证上的信息。除此之外，余下多张均为露点照片，以及部分手持身份证拍摄的裸体视频。
这名出售者表示，仅16日上午已经将这些裸照出售给10多人了，但自己拿到的也不是第一手照片，是从“搞裸持贷款”的手中买的资源，可以持续更新。北青报记者询问这些裸照及视频来源，对方称贷款逾期不还，“裸持”出借人就会放出一批照片。

出售裸照涉嫌传播淫秽物品
对此，北京律师张新年表示，将女大学生的裸照发布到网上，侵犯了女大学生的隐私权，作为受害者，可对发布者主张民事侵权责任，“轻者公安机关可对其予以治安处罚，重者可以侮辱罪追究其刑事责任。”
对于出售者称“这些裸照都是逾期没有还款的女性的照片，是因为这些女性违约在先才出售”的说法，张新年指出，即便女大学生自愿给出裸照，并且违反还款的约定在先，也不能免除售卖者和传播者等相关侵权、违法、犯罪主体的侵权责任、治安责任和刑事责任。
北京盈科律师事务所刑事部主任易胜华则表示，裸照的出售者、转手者、传播者都属于传播淫秽物品。“要判断有没有构成犯罪，要看他们传播淫秽物品的数量和牟利的数量，比如，淫秽视频、照片等发布到网上就要看点击率和阅读量，如果将淫秽物品出售，就看销售淫秽物品的数量和他们获取金额的数量。”
易胜华表示，从法律上讲，这些将自己裸照传给他人的女性，本身就在传播淫秽物品，她们的行为也构成了违法，如果她们发现其他人在利用她们的裸照牟利，可以向公安机关报案，也可以跟对方通过协商解决，告诉对方行为已经违法，并要求对方不再传播。
易胜华解释，“裸照本身并不是物品，因此不能当抵押物，即使用来抵押，因为是非法的，这种抵押行为也是无效的。”
