统计显示，近年来国际油价虽一路下跌，但国内外成品油差价始终维持在每吨1000元左右，最高时接近2000元。中小型捕捞渔船一般为数十至数百吨，这意味着走私分子每走私一船成品油，即可获利40万元上下。高额差价下，走私分子一次次铤而走险。
日前，广州海关发布信息显示，在5月份对一起疑似成品油走私逃税的调查中，中国海关和警方联合行动，扣留了新加坡籍的贡渥（Gunvor）新加坡公司董事总经理Yin Dikun及其他多名涉嫌走私的犯罪嫌疑人。少见的扣留外籍人员又让油品走私“黑金”交易再次曝光在公众面前。
中国海关总署新闻办工作人员在接受《中国经营报》记者采访时坦言，近年来，油品走私近两年来又多了起来，且呈现走私团伙化、链条化等新特点，总局也加大了与相关部门配合打击力度。从去年开始在全国开展一系列专项打击行动。
石油走私卷土重来？
清晨，一艘渔船带着几乎全空的油罐离开中国港口。进入公海海域后，走私分子将油轮上的走私油品加给渔船，价格较标准柴油每吨低上千元。渔船捕鱼结束后就带着满满的油罐驶回中国内地市场销售。这是海上石油走私的经典一幕。
今年以来油价的大幅波动及“地板价”政策的实施，走私利润空间加大，油品走私在沿海一带又有沉渣泛起、再度猖獗之势。而且组织更加严密、呈现隐蔽性，甚至不少国外势力参与。
记者了解到，随着利润空间加大，东南沿海一带参与走私石油的船只和渔业从事人员有不断增多趋势，巨大的利润空间往往还吸引周边地市民众参与。
一位浙江瑞安籍渔民告诉记者，从去年开始飞云江一带走私就很厉害，走私分子一般多是半夜行动，深夜两三点时有很多渔船就在飞云江码头一带卸油，根本不把政府监管放在眼里。“2015年瑞安最赚钱的行业就是石油走私，一晚上能赚几十万，”该渔民揶揄道。
而在瑞安西南相隔不远的福建南平地区并不沿海，成品油市场受走私、非标油冲击严重，中石化、中石油柴油市场占有率流失超30%，国家燃油税率因此流失严重。
据测算，目前从境外走私进来的油品的价格较沿海地区通过正规渠道进口的国标柴油价格低1000元/吨以上，因此在内地市场具有很强的竞争力。
“而今年情况又有一些变化，地板价政策实施后国内外油价价差拉大、油价倒挂导致成品油从境外走私进入沿海地区突然又增加了不少。”广东石油商会信息部部长姚达明认为，“根源还在于油价形成机制。”
中宇资讯分析师张永浩告诉记者，石油走私屡禁不止的根本原因在于油价形成机制、税收政策导致的国内外油品价差，及由此而来的巨大利润空间。
目前，走私柴油主要是来自中国香港、台湾地区，以及东南亚地区的免税柴油。其中，香港特区政府为生产渔船提供的免税柴油，因加入了红色染色剂，俗称“红油”。而“白油”“蓝油”则来自中国台湾地区和东南亚地区特别是新加坡。还有部分是国际运输公司的往返油轮利用在我国港口停泊的机会提供部分成品油。这些免税柴油与大陆市场的0号柴油相比，差价明显，因此备受“青睐”。
此外，由于隐蔽性强、可以逃税，近年来轻质循环油、稀释沥青的走私成为新的热点。“目前，国内油品市场需求偏弱，一旦国内油品需求增强，价差扩大，油品走私将沉渣泛起。”张永浩表示。
石油黑金链条隐蔽
随着走私团伙的分工日趋细化，油品走私逐渐形成了公司化、专业化、隐蔽化的一条龙运作。包括购买—运输—接卸—加工—销售多个环节，从负责联系、资金、看水、打点关系等事项均有专人负责，环环相扣。在广东、福建沿海一带还有不少披着正当贸易外衣的贸易公司，一边从事合法贸易，一边暗箱运作成品油走私，让打击走私石油的难度不断加大。
在去年9月份，海关总署与中国海警局、全国打私办联合开展的“春雷”专项行动中，南京海关成功破获长江流域最大一起走私成品油大案，抓获犯罪嫌疑人26人，查扣走私油船2艘，全案查证涉案走私成品油34000余吨，案值2.5亿多元，涉税6800余万。
侦查中海关缉私警察发现，成品油走私团伙内部分工明确，形成了一整套走私和销售链条。
本案中，余某为该团伙总策划，2013年他召集吴某、马某、孙某等商量购买油船走私柴油，并与台湾籍走私嫌疑人陈某联系买油。每次联系装油时，陈某通过电话、微信等方式，指挥境外大型走私海轮停泊在公海，使用纸币的后四位号码联系“海观山66”等大陆海油船接头，以事先约定的“斤”“吃”“吃饱了”等暗语代替重量、过驳进行柴油装卸。待走私油船和境外走私母船靠一起后，吴某按照陈某提供的地下钱庄账号，将油款汇出，陈某收到货款后，通知走私母船卸油。
山东东营是我国成品油调和基地，马某这个东营本地人在当地有一定知名度，在团伙中他是走私成品油销售的关键一环。他在东营成立了所谓的柴油销售公司，为使走私成品油销售合法化，马某还向油库虚开购买油的增值税发票，再将走私油调和后向国内销售。
不仅团伙走私分工明确、多用合法经营的外衣包装，隐蔽性强，一些渔民走私也有着细致的分工。
上述瑞安渔民告诉记者，一些几吨到数十吨不等的流动渔船，把货仓、压水仓等改装成油舱，在海上装油后运入沿海地区，在夜间到非设关地点偷偷卸货，到岸也是分批分段到岸，一有风声就可以掉头撤，据说后面还面有人给他们通风报信。走私分子少拉多跑，走私油量达不到标准，也无法追究刑事责任。
刑法第一百五十三条规定，对走私普通货物、物品罪，应根据偷逃应缴税额进行处罚。而走私犯罪起刑点为偷逃税款5万元人民币以上，以此计算，走私成品油必须达到80多吨才能构成走私犯罪，否则只能进行行政处罚。
“只要有差价和利润空间，走私分子就会拼命钻政策和监管的空子，”一位民营油品贸易商对记者表示，一个港湾就有多处偷卸点，加上绵长的海岸线，上岸一二个小时就可以将油抽光，成品油走私可以不断转移地点、变动偷卸地，监管难度很大。
1998年打私风暴后，海关加强了对大、中型船舶的监管，大规模直接走私减少，走私分子利用化整为零的手法，组织众多小型船只走私成品油。这种“蚂蚁搬家”的油品走私方式，迫使海关等监管部门只能以散打散，使得监管难度和成本大大提高。而且在东南沿海打击力度不断加强的背景下，油品走私有向内陆渗透和北方沿海延伸的趋势。
“如今国内油品走私方式、来源、组织形式、区域等有了新的变化，海关在打击油品走私问题上所面临的局面比以往更为复杂，”上述工作人员坦承。
