个人为山区孩子募捐需经审核
很多人都在微信朋友圈看到转发的各类求助和募捐信息，昨日参加论坛的市民和嘉宾也关注到网络募捐的新方式。
“有数据显示‘轻松筹’去年共有23000宗求助个案，募集了1.8亿元，全国有360万人在上面捐了钱。但这种网上募捐平台信得过吗？有媒体曝光有不法分子利用这些平台实施诈骗行为，对于大众的质疑，相关职能部门有没有监管及惩处措施？”特约嘉宾一鸣提出疑问。
全国人大代表、《广州律师》主编陈舒认为，应该区分两种概念，如果是个人为自己或者亲戚朋友募捐，法律是允许的。
但是，新《慈善法》禁止个人没有经过法律允许向不特定人群的募捐行为，例如个人为山区孩子募捐。如果要进行网上面向不特定人群的募捐，必须要通过有资质的慈善组织，并且经过民政部认证和审核。

陈舒还强调，目前朋友圈上很多求助信息，都注明“求转发”，但转发此类信息需慎重，搞不好就助长网络信息诈骗。“因为转发他人求助信息就不是个人求助行为，而是个人募捐了，如果没有经过审查可能帮助诈骗分子扩大诈骗范围，给别人造成损害。”陈舒说，“网红”特别要小心，弄不好可能就会成为诈骗“共犯”。
对于政府救助，嘉宾们强调了其重要性。“老百姓一遇到困难，不是马上想到找政府民政部门，而是第一时间找媒体和慈善组织，这个我觉得不是应该提倡的方向，因为我们的慈善资源是有限的。”嘉宾一鸣还指出，救助跟慈善应该是“一体化”，政府救助做不到，或者没办法才由慈善加入，政府的救助功能应该进一步强化。
