南海研究院院长:未来南海秩序不应由域外大国主导

  中新社海口6月22日电 (记者 杨旭 关向东 王子谦)中国南海研究院院长吴士存近日在海口接受中新社记者专访时指出,目前尚无地区安全机制覆盖南海,但未来该地区的秩序,不应由域外大国来主导。


  吴士存从历史和法理角度指出,中国是最先发现、最先命名、最先把南海诸岛纳入版图、最早设置行政管辖且行政管辖连续不断的唯一国家。史料记载,中国早在汉代就已发现南海诸岛,唐代即设置行政管辖,北宋始中国即派水师巡视,明清时代更是通过航行和渔业活动,积累起对南海开发基础之上的有效管辖。


  作为二战战胜国,中国根据《开罗宣言》和《波茨坦公告》等一系列国际条约恢复对南海诸岛的主权,并在随后出版的《南海诸岛位置图》标绘南海断续线,对南海诸岛主权进行巩固和确认,得到了包括南海周边国家在内的国际社会的广泛承认。


  “中国恢复对南海诸岛行使主权和主权权利构成了战后国际秩序的一部分,挑战中国对南海诸岛主权就是挑战战后国际秩序、就是对现行国际秩序的反对。”吴士存说。


  吴士存说,中国在南海的权利主张内涵主要包括三个方面,即主权、海洋权利和历史性权利:


  中国对南海诸岛的主权基于发现和先占而取得,虽然主权在历史上曾一度被外国侵略者剥夺,但二战后中国又根据一系列国际条约予以收复;


  中国在南海享有的海洋权利是伴随着现代海洋法的诞生和发展而逐步形成的,依据《联合国海洋法公约》(简称《公约》)提出相应的海域主张,是《公约》赋予任何一个缔约国的神圣权利;


  中国在南海享有的历史性权利,是若干世纪以来中国人民在南海开发经营和生产生活过程中逐步积累和沉淀下来的权利,它在现代海洋法产生以前就已经存在,试图以《公约》来否定中国在南海的历史性权利显然不仅有违“法不溯及既往”的国际法基本准则,而且有失公允。


  吴士存说,美国2011年推行“亚太再平衡”战略,真正意图在于巩固建立在双边联盟基础上的亚太地区霸主地位,维持对亚太地区秩序的主导权。


  他说,在目前没有一个地区安全机制覆盖南海的情况下,本地区的安全秩序处在调整和演变中。中国是本地区最大的经济体,南海最大的沿岸国,是南海诸岛真正的主人,南海对于中国的重要性要超过任何一个国家,中国不会接受未来的南海秩序由任何一个域外大国来主导。


  针对南海危机管控机制缺失,吴士存建议,一方面推动《南海各方行为宣言》框架下的海上合作,另一方面要加紧磋商“南海行为准则”,充分考虑各方关切,尽快发挥其作为未来南海地区危机管控机制的作用。
