湖南衡阳“雷政富案”二审宣判 10名案犯量刑减轻
6月22日，澎湃新闻从湖南省衡阳是石鼓区法院获悉，衡阳“雷政富案”已于近日作出二审宣判。衡阳中院6月13日作出的判决书显示，唐国清等12人均被判犯敲诈勒索罪，分别被判管制1年至11年有期徒刑或缓刑不等的刑罚，并处以罚金不等。
其中，唐国清、漆建国、李毅等人在多起作案过程中曾起领导组织作用，系主犯，分别被判11年、10年、7年不等的刑期。
一审判决认定，以唐国清等人为主犯的6男6女团伙，为谋取非法利益，商议利用女色引诱被害人，在与被害人进行暧昧通话时录音或者与被害人发生性关系时偷拍视频，然后将装有录音、录像的光盘、U盘送给被害人进行敲诈勒索。
2009年下半年至2013年10月，该团伙在湖南、湖北、江苏、浙江等省多地作案55起，涉案金额近245万元。
衡阳中院二审认为，一审判决认定事实清楚，证据确实、充分，定罪准确，但对部分上诉人和原审被告人量刑不当，追缴违法所得错误，依法予以改判。
二审判决书显示，除王小丹、侯雨兵2人的量刑被维持，其余10人的量刑均有不同程度的减轻。
澎湃新闻此前报道，自2009年到2013年，湖南、湖北、江苏、浙江四省数十名官员遭遇了“雷政富”式的敲诈：敲诈者利用女色引诱被害人进行暧昧通话或发生性关系，同时录音、偷拍视频，之后再敲诈勒索。
2015年11月，该案在衡阳市石鼓区法院一审宣判，12名被告人被以敲诈勒索罪分别判处1年管制至14年有期徒刑不等。
澎湃新闻注意到，到目前为止，只有衡阳市纪委公布了对涉案的6名官员的处分，其他地方未公布对涉案官员的处理情况。在一审判决书中，该案中被色诱、敲诈的以官员为主的被害人的名字、职务等身份信息均被隐去。此次的二审判决书中，被害人的上述信息亦被隐去。
此外，早在2011年，该案的3名主犯就已经被抓捕并判缓刑，在缓刑期间，该团伙依然四处作案。侦办警方得知更多官员被敲诈，却未上报衡阳纪检部门。
