  2016年6月21日,在辽宁省清原满族自治县经商的周文刚打电话告诉法治周末记者:“我们就是要政府兑现《房屋征收补偿协议书》,但他们推来推去。找政府办事怎么就这么难?”


  周文刚夫妇是江苏泰州人,30年前即来清原搞装修,馒头咸菜就开水,夜晚打地铺是经常的事,由于人实在、活干得好,颇受当地人欢迎,都亲切地称呼他为“大周”。2004年,周文刚夫妇买下清原中药厂的三层旧厂房,经过改造经营家居装修。


  正当他们经营红火的时候,2012年8月,接到了政府的通知,清原县政府进行旧城区改造项目,欲将这里改造成12层的金墅家园商住楼。


  经过数次谈判,与房屋土地征收中心(以下简称征收中心)签订了两份《房屋征收补偿协议书》。在签订第三份协议时,征收中心原主任张翅宇调离,新主任艾民却不太积极,以至于最终通过行政诉讼才解决。


  3年来,三份房屋征收协议无一兑现,周文刚夫妇整日奔波于征收办和县政府之间。周文刚对记者说,征收办主任艾民表示不能履行合同,让他去法院告拆迁办,并称“你要跟我胡搅蛮缠,我还什么都不怕。清原县活埋人的事我都干过”。对于这句话,记者向艾民求证,他并不否认,只是说那是气话。


  新官不理“旧账”


  从2004年起,周文刚夫妇接手中药厂的旧厂房,改造后经营家居装修。正当生意做得红火,2012年清原县政府启动了该中药厂所在地块的旧城区改造项目。


  接到通知,2013年8月7日和12日,周文刚和妻子先期与作为甲方的县政府所属的征收中心签订了007号和008号协议。


  这两份协议中,作为乙方的周文刚夫妇选择置换金墅家园小区的一层4号、5号和6号门市房,面积分别为28.72平方米、45.13平方米和45.13平方米,并在“双方其他约定事项”中载明要南北通透。选择置换二层第1到12号门市房总共645.1平方米。


  双方还约定:甲方须保证1、2、3层楼有消防安全通道;乙方之前三楼的面积为401.252平方米的无照房,乙方按照每平方米1500元给予货币补偿,置换新楼。


  但艾民接任征收办主任后,不仅007号和008号协议行不通,连周文刚夫妇与前任征收办主任张翅宇议定好的009号征房协议也卡了壳。


  周文刚告诉记者,艾民曾跟他说:“如果不服可以起诉。”


  2013年11月12日,周文刚提起行政诉讼。2014年9月,新宾满族自治县人民法院作出行政判决,之后下达行政裁定书,直到2014年10月8日,在主管县长的督促下,艾民才勉强签下了009号征房协议书,同意周文刚置换1层3号门市房,面积56.47平方米。


  009号协议签完,周文刚感觉一块石头总算落了地。


  但好景不长,楼盖好了,转年开始配户,难题又来了。


  “现在我算明白了,每走一步,他就让我起诉一步。”周文刚饱含着着心酸对记者说,“在艾民那儿,自己之前和征收中心所签的协议成了一纸空文。要么推诿到开发商处、要么就让我去告。新签合同要打官司、配户要打官司、补助费也要打官司……”


  据了解,房子被拆后,置换房迟迟不能配户,补助款落实不力,现在周文刚已欠下房租、诉讼费、利息等费用共计上百万元。


  征收办主任的“办法”


  楼盖好了,转年开始配户,难题又来了,周文刚发现实际配户与协议相差甚远,1层3号门市房少了近10平方米。


  不仅如此,周文刚还发现,一层原本该南北通透、前边经营后边进出货物的四间门市用房,仅有一间设置了比其他南北通透的门市明显狭窄的大门,算是勉强符合协议。二楼协议明确约定的12间门面,征收中心只答应给8间,少了100多平方米。


  另外,拆迁补偿费用未能完全落实。按照《国有土地上房屋征收与补偿条例》规定,应该是先补偿后动迁。周文刚说,自己曾多次讨要,而艾民多以“开发商没给我钱”为由搪塞。“实际上其他拆迁户补偿款都已补发到位”。


  “现在是法治国家,你要补偿款我不给,你可以找开发商、可以起诉啊。”艾民对周文刚不断讨要拆迁费,给出了解决的“办法”。周文刚说。


  就这样,周文刚再一次提起行政诉讼。2015年7月27日,经清原县法院审理,以双方协议书上已约定“甲方支付乙方的费用可抵顶乙方所承担的费用,待配户时一并结清”,因现在并未配户,原告要求支付费用条件没有成就,法院不予支持为由,驳回了周文刚的诉讼请求。


  “法院判决是让在配户时将费用一并结清,问题是现在没法配户。”周文刚告诉记者,因为配户的房屋和合同出入太大,艾民不同意按合同配户。要么把我们推到开发商处,要么就让我们去法院起诉。


  一位不愿透露姓名的知情者告诉记者,在配户时房屋面积和户型与实际严重不符的,征收办和开发商都负有不可推卸的责任。


  在其提供的《清原满族自治县房屋土地征收中心(甲方)和抚顺市晨宇房地产开发有限公司(乙方)所签的《D7(中药厂)地块土地整理协议书》中记者看到:“乙方保证所提供的用于产权置换的房源单套面积、户型等必须符合甲方的产权置换要求。如因房源数量、单套面积、户型等不符合甲方的产权置换要求,而影响征收补偿工作的,乙方承担全部责任。”


  “此份协议是征收办和开发商签订的。配户出现问题,征收办有责任督促开发商积极解决。而非包庇、推脱责任,让被征迁户自己去找开发商、区法院告。”上述人士向记者表示。


  “虽然黑纸白字的协议,但每一条都没能落实。”周文刚告诉记者,艾民知道他不断到相关部门信访、申诉,便告诉他,“你们投寄给县长、县委书记、人大等部门的材料现在全都扔进我纸篓里了。我的纸篓够大,里面还能装!”


  政府的许诺兑现无期


  通过清源县委宣传部的多次联系,4月18日下午5时许,记者终于见到了艾民。


  对于周文刚一事,艾民给出了自己的解释,007号和008号协议都是在上任征收办主任张翅宇的主导下超标准签订的,他认为,配户给周文刚的房屋如果不按合同,实际比正常标准多给了133平方米的面积。


  “合同是合同的事情,我说的这个是按照正常标准。”艾民说。


  另外,“南北不通透就是个既成事实”。艾民表示,楼盖起来了,现在要求南北通透根本不可能了。“如果要南北通透了,就不可能把消防通道建设上,建设上消防通道之后,肯定不能南北通透。这是鱼与熊掌的关系。”


  艾民也向记者承认,虽然图纸从一开始就是这么设计的,但在签协议的时候征收办还是和周文刚夫妇签订的“南北通透”。“这是个历史遗留问题,当初签这个协议的时候,我还没有来呢。”


  目前,在清原镇站南街上只有D7地块(周文刚买下的中药厂旧厂房)被旧城改造。但3年多过去了,在这条站南街上还有不少超过10年的平房没有被改造掉。为何10多年的平房不改,唯独周文刚的临街三层小楼被改造了?


  上述人士还指出,按照国务院的规定,土地出让应该先挂牌再净地。在日期为2012年7月24日的《D7(中药厂)地块土地整理协议书》中明确,由甲方(清原满族自治县房屋土地征收中心)负责土地整理,包括地上建筑物及附属物的征收补偿、评估、征收物拆除等工作。但实际情况是,地还没有清理干净,征收工作还没有做完,就早已经把此地块挂牌拍卖了。“如此种种,可见县里某些部门与开发商交情不浅。”这位知情人士说。


  对此,艾民解释说,现在国务院虽然要求净地上市,但是在实际操作中,政府没钱去净地。目前,全国各地没有一个地方是按照真正净地实施招拍挂的项目。


  “现在艾民的态度只有一个,就是让我起诉。”周文刚对记者说。为了按照协议得到安置房,他曾多次找到主管县长吴振宇、县长刘培宏请求解决,但县长们“立即解决”的许诺却兑现无期。到县信访局所递材料,也如石沉大海。


  6月13日,主管县长吴振宇刚刚再次答应了帮助自己解决,但第二天又把问题转回到征收办主任艾民那里。艾民干脆把自己的电话拉黑了。


  周文刚向法治周末记者表示;“我现在对未来生活很茫然,自己不知道该怎么办,哪里能够帮我们解决问题?”
