　　南都讯 记者门君诚 深圳龙岗区法院原审判员史某，故意违反执行程序，使浙江义乌商都开发公司（下称义乌商都）损失7000余万。记者昨日从佛山市南海区检察院核实得知，史某涉嫌滥用职权罪，经省检察院指定由该区检察院管辖办理，目前该案正在审查起诉阶段，犯罪嫌疑人史某暂被取保候审。

　　有媒体此前披露，义乌商都股权被违法贱卖，背后直接黑手即是黄常青。黄常青曾担任龙岗区法院院长，为史某的顶头上司。而义乌商都总经理欧总和20多名股东就是黄常青的举报者之一。

　　据广东省检察院公布的案情称，2010年至2011年期间，犯罪嫌疑人史某在承办深圳龙岗伟发公司申请强制执行义乌商都持有的深圳义乌小商品批发城有限公司40%股权案中，故意违反执行程序，使义乌商都持有的40%股权被低价拍卖，造成其直接经济损失7463.625万元、红利损失80万元。

　　南都记者了解到，该案在执行过程中，作为龙岗法院执行法官的史某故意将执行相关等法律文件寄往义乌商都变更前的地址。文件被退回后，又故意在发行面较窄的《人民法院报》上刊登送达公告，致使义乌商都对执行案件的情况完全不知情。

　　另外，史某在选择评估、拍卖机构时，既没有通知义乌商都，没有依法采取随机摇珠选择，而是违法直接指定，事后也没有将选择情况送达义乌商都，严重违反法律规定。

　　广东省检察院在通报中称，义乌商都股权被低价拍卖后，“因此多次组织群体性上访，造成恶劣社会影响。”深圳市检察院在广东省检察院的指导下立案侦查，2015年上半年，史某被执行逮捕，犯罪事实基本查明后移交佛山市南海区检察院管辖办理。目前，史某涉嫌滥用职权一案仍在审查起诉当中。
