自5月13日雷洋案件启动尸检程序后，雷洋尸检结果成为社会关注的热点，这一结果将直接关系到该案件的定性。就在人们根据“专家预计的30左右出结果”而判断该结果即将出现时，今天（6月25日）下午，雷洋案涉案警察邢某的代理律师钱列阳、公孙雪向北京市检察院第四分院递交了一份《法律意见书》，提出“因鉴定机构的确定程序违背相关法规、网传北京明正司法鉴定中心资质存疑”，建议检察机关更换鉴定机构。
在这份《意见书》中律师提出：邢某涉嫌渎职犯罪一案，北京市昌平区人民检察院根据雷洋家属的意愿，委托北京明正司法鉴定中心进行尸检鉴定，雷洋家属及其委托的专家辅助人在场，北京市人民检察院派员监督。辩护人认为，本案法医鉴定机构的确定程序违背了刑事诉讼法规定，北京明正司法鉴定中心已经不具备中立性，难以排除干扰开展鉴定；同时该机构虽有鉴定资质，但历年来开展业务已经积累了一些争议纠纷，从专业技术角度看，难以保证鉴定工作质量。
钱列阳告诉记者，今年6月份，邢某家人委托他代理邢某的案件后，他已经会见了当事人，并到案发现场进行了较为详细的实地观察。由于目前案件还处于侦查期间，案件的具体细节尚不清楚，但为了把这一全国关注度极高的案件办到没有瑕疵，在目前尚未接触到实体案情时，应确保程序上没有瑕疵。
钱列阳进一步说道，在指定鉴定机构时，涉案警察还没有聘请律师，所以指定鉴定机构时没有涉案警察的声音是正常的，但目前既然已经委托了律师，律师就有义务从程序上做到没有瑕疵。对于网络上传言鉴定机构法律资质存疑一说，钱列阳表示，由于他们都是随后接手的案件，与鉴定机构不存在任何关联，如果网络传言属实，那么就存在3个层面的问题：鉴定人资质、鉴定机构资质和鉴定结果是否有效的争议，为了确保以后进入法庭审理阶段不再因鉴定机构存在争议，建议检察机关应依法更换司法鉴定机构。
随后，记者拨通了雷洋代理律师陈有西的电话，就下午钱列阳律师建议更换鉴定机构的情况询问其是否知情，陈有西表示并不知情，并表示不对此事发表任何看法。

北京市人民检察院官方微博“北京检察”1日发布，日前，北京市昌平区人民检察院完成对“雷洋涉嫌嫖娼被民警采取强制约束措施后死亡”线索的初查工作，认为符合立案侦查条件。
根据办案的实际需要，北京市人民检察院决定，将该案交由北京市人民检察院第四分院立案侦查。2016年6月1日，北京市人民检察院第四分院依法 决定对昌平区公安分局东小口派出所民警邢某某等五人进行立案侦查，按程序通知家属。同日，北京市有关检察机关控告申诉检察部门还向雷洋家属吴某某通报了检 察机关办理案件情况。（新华社 记者涂铭 熊琳）
