“2015年，衡阳市共完成474座小型病险水库除险加固任务，完成数量相当于前10年的总和……”湖南省衡阳市水利局日前晒出2015年全市水利建设“成绩单”。作为主管水库除险加固业务的该局原副调研员兼市水利建设与管理站（简称市水利建管站）站长的刘向阳，本可以此为荣，然而，此刻的他却身陷囹圄，悔恨度日。
在担任市水利建管站站长期间，刘向阳曾被国家水利部评为全国水利系统先进工作者,被衡阳市政府授予个人二等功。然而，在光鲜的外表下，刘向阳却利用职务便利，通过乱收费、套取财政资金，违规设立小金库773.5万元；收受贿赂40万元。近日，刘向阳被开除党籍、开除公职，并被移送司法机关。

“水库除险加固工作中的初步设计评审、安全鉴定评审均由市水利建管站负责。能不能动动手脚？”经过一番思考，刘向阳想出了在评审过程中强制收费的敛财招数。随后，他安排下属对相关评审费用进行核算，并定下了收费标准。同时，刘向阳要求该站干部李方（另案处理）到银行开了一个私人账户，打算把违规收取的钱存入这个小金库，并决定由李方负责记账，自己负责审批。
准备妥当后，2007年下半年，刘向阳召集该站党支部书记李先庚（另案处理）等班子成员集体研究了这套收费方案，并表示收来的钱将作为福利发给大家。虽然明知道这属于乱收费行为，但人人都能沾光，班子成员便一致通过了刘向阳的提议。
很快，市水利建管站迎来了一批需初步设计评审的病险水库。刘向阳按照规定流程把相关县（市、区）水利局分管水库除险加固业务的领导召集在一起开会，并借此机会让李方在会前收取初步设计评审费。有了第一次，收费就在各地慢慢推开。
由于交费后市水利建管站无法开具发票，各县（市、区）水利局的大量资金不能报账，这使得他们怨声载道。为平息怨气，2012年，刘向阳将收费标准大幅降低。2013年以后，市水利建管站不再统一收取评审费，而由各地水利局直接交给评委及工作人员。
2007年至2012年，市水利建管站共违规收费719万余元。其间，刘向阳还通过虚开发票套取资金54.5万元。这些钱全部存入小金库，并用于发放福利、公务接待、旅游等开支。其中，刘向阳个人分得19.5万元。
“打招呼”搞项目——
肆无忌惮收受巨额贿赂
衡阳市水利建管站除主管水库除险加固业务外，还负责全市县管以上重点小型和中型水库的防汛安全检查，水利工程维修、改造等项目的审查管理，权力不可谓不大。作为该站一把手的刘向阳，以此搞起了权钱交易。
2010年4月，经一位老领导介绍，刘向阳在饭局上认识了做水利工程的老板周某。此后，周某频繁联系刘向阳，经常向刘向阳打听水利项目信息，并直言“赚到钱后知道怎么做人”。刘向阳看周某如此“上道”，就表示会重点关照。
一个月后，衡阳市水利局组织召开全市病险水库除险加固工作会议，会后刘向阳将与会的某县水利局领导叫到办公室，向他介绍了周某，并要求帮助其搞点项目。碍于刘向阳的“虎威”，该县将一病险水库除险加固工程交由周某承接。事后，周某送给刘向阳10万元感谢费。此后，刘向阳多次利用检查工作、约请吃饭、打电话等方式向该县领导打招呼，又帮助周某承接了该县两个病险水库除险加固工程。承接的项目多了之后，周某的“回报”也加了码，这次送给了刘向阳20万元。
此后，周某开始拓展其他县的业务，再次找到刘向阳。知道有利可图，刘向阳更加肆无忌惮，打电话给多个县（市、区）的水利局领导要求对周某“多多关照”。在刘向阳的帮助下，周某获得了6个县的病险水库除险加固工程，并又送给刘向阳10万元。
毁账簿“做手脚”——
装聋作哑对抗组织审查
为防止内部矛盾，刘向阳每年都向班子成员通报小金库收支情况。会后，刘向阳当场安排李方销毁小金库当年度的所有账簿及原始凭证，只保留手写的年度收支汇总表，以方便下年度对账。刘向阳自以为查无对证，便可以高枕无忧了。然而，世上没有不透风的墙。
2015年3月，衡阳市纪委收到群众来信，举报衡阳市水利建管站乱收费的问题。随后，该市纪委成立调查组进行初核。调查组选择了水利工程较多、资金量较大的两个县作为切入口，由于本来就对市水利建管站乱收费的行为颇为不满，因此，市纪委一来调查，相关人员就主动告知，具体收取评审费的是市水利建管站干部李方。
当市纪委来到市水利建管站开展调查后，刘向阳有了危机感。他立即召集该站班子成员商讨应对之策：“现在纪委来查评审费的事，大家一起想想办法。收取评审费最多是乱收费行为，到时候把钱退回去就行了，但决不能让纪委知道咱们有小金库，还分了钱。”紧接着，刘向阳提出“先把小金库的支出改成评审会务支出”的意见，得到大家的认可。随后，刘向阳安排李方对评审费的支出做手脚，对抗组织审查。
刘向阳自以为攻守同盟的堡垒坚不可破，在谈话初期，总以“不清楚、不记得、不明白”对抗调查。然而，随着调查的深入，刘向阳感觉糊弄不过去了，才交代了自己的违纪问题。
衡阳市纪委相关负责人介绍，该案包括刘向阳在内，共有7名水利系统党员干部被查处。为防止此类案件再次发生，衡阳市纪委深刻剖析了案件发生的原因，从完善制度建设、提高干部队伍素质、健全监督制约机制等方面提出了预防措施。衡阳市水利局针对此案开展专题研讨，并在全市水利系统开展专项整改活动，对存在的廉政风险和管理漏洞切实整改到位。（本报记者 邹太平 通讯员 刘云 李涛）
