毫无疑问,对于任何一家高科技企业而言,技术是企业生存和发展的基本保障。而企业的技术实力究竟如何很大程度反映在其专利数据上。

这次,我就以近几年一直处于行业风口浪尖的小米公司作为样本进行分析。

一直因为缺少技术而为部分人所诟病,但实际数据显示其实小米公司的专利数量上并不少。不仅总数上达到惊人的7171件,而且92.55%是发明专利。这对于一家成立才六年的公司而言,已经算是十分可观的了。不过由于公司成立时间尚短,绝大部分专利还处于申请阶段,实际已经授权的比例仅占12.62%

进而从下图专利趋势来看(2016年数据截至到六月份),小米公司的大多数专利是在最近两年才开始申请的,尤其是2016年,仅仅在上半年小米的专利申请数量就已经接近全部专利数的的三分之一。很显然,小米在成立的最初两年几乎没有在站立的申请和储备上给予足够重视,导致后面在海外市场的开拓上受挫,这才开始意识到专利的重要性,开始奋起直追。不过经过最近两年的努力,小米在专利方面的巨大进步还是有目共睹的。但毕竟起步较晚,授权比例尚不高,相信未来几年会有大幅度提升。

不过从下图地区分布上来看,目前小米80%左右的专利都集中在中国大陆,美洲日本印度等国家地区的专利都非常少,这显然对于一直急于拓展海外市场的小米而言非常不利。缺少足够核心专利的保护,小米想要拓展海外市场还有很多障碍需要突破。(根据数据库提供的不完全信息显示,小米分别于13年和15年在美国被一家叫Blue Spike, LLC的公司告到德州法院,尤其是第二次,标的涉及几乎小米所有在售手机型号。)

下图是小米在各个国家的专利数量趋势。可以看到,小米近两年的专利数量的突飞猛进都仅仅集中于中国大陆,在其它国家地区的专利数量发展仍然不温不火。小米想要在海外市场有所突破,这样的发展速度显然是不够的

当然,要了解一家高科技供公司的技术和发展方向,单纯的专利的数量还是依然无法说明太多问题的。下图的关键字标签云和圆盘图上,我可以进一步了解小米的专利分布情况和其业务的兴趣点。可以看到,小米专利主要还是聚焦于手机及相关智能设备的应用层面,这点和小米一直非常重视的MIUI的用户体验是非常吻合的。作为小米的看家本领,其在使用体验方面的着力,从专利数据分析上也可见一斑。不过遗憾的是,看起来小米在硬件本身的专利技术还非常欠缺。这对于一家以硬件为基础的科技公司而言是一个非常大的软肋。

另外,从下表的技术聚焦的领域来看,基本能够印证前面的观点。硬件尤其是通讯和芯片领域显然是小米需要尽快补上的短板。目前小米通过和联芯合作也开始切入手机芯片等领域,相信未来会多少有所弥补这方面的缺陷。还有一个有趣的现象是,小米的专利里大量出现了净水器/电饭煲的专利,而同样属于小米生态公司产品的无人机/平衡车等专利却几乎没有体现出来。小米和其投资的生态公司之间专利究竟是如何分配和布局?这是一个值得后续进一步了解的问题。

所以,综合上面的数据相信我们可以大致得出以下结论

1) 小米成立初期在专利积累和布局上有明显不足,但遭遇一系列问题后,他们近两年开始在专利上非常重视,并取得了非常大的进展。其发展速度是远超很多人的预料的,而且未来发展更值得大家期待

2) 但是同时也应该看到:

a) 小米在海外的专利布局还远远不够,这导致其在短期内要大幅度拓展海外市场有极大的难度。一旦涉足海外市场,他们将面临大量的专利诉讼的麻烦。从其他渠道获得的信息来看,也确实如此。

b) 小米的专利在技术领域布局上还存在明显的不均衡的问题。大量专利技术还停留在用户界面和使用体验上,真正核心的硬件/芯片及底层通讯协议方面的技术还十分欠奉。这些技术的开发需要大量的资源投入和时间积累,显然小米依靠自身力量要在短时间内弥补是极其困难的,目前唯一的办法是和外部的资源合作,以及通过购买专利和公司并购来实现。相信小米已经在这块积极努力了。
