　　2014年4月28日上午11时许，福建闽侯发生了一起恶性驾车撞人案。林建新驾驶着一辆雷克萨斯轿车，在青口镇镜上村、庄头村、凤港村等2.7公里路途中故意改变行车方向，肆意撞击无辜行人，造成7人死亡(其中4名未成年人)，15人不同程度受伤和车辆损毁价值人民币4万余元的严重后果。

　　经福州市中级人民法院一审审理查明，被告人林建新，福建长乐人，与张某于2008年6月结婚并育有一女。2011年10月，二人因感情不和而分居，此后张某多次提起离婚诉讼。长乐市人民法院决定于2014年4月28日开庭审理二人离婚案。林建新因张某决意离婚心怀不满，而产生报复之念。开庭前一日，林建新即从汽车租赁店租借了一辆雷克萨斯轿车，准备了汽油、斧头、除锈剂、旋气钉等物品，放入车内伺机作案。4月28日，庭审开始之前，林建新趁人不备用旋气钉将张某所乘坐的现代牌轿车的一个轮胎泄气。庭审中，张某坚决要求离婚，林建新不同意，法院未当庭宣判。庭审结束后，张某的舅舅发现轮胎被泄气，随即更换轮胎后载上张某和林某、李某等共7人离开法院，沿203省道往闽侯县方向行驶。

　　林建新驾车尾随至长乐营前街道下洋村路段时，故意撞击现代牌轿车，迫使轿车停车。车上四人下车查看时，林建新持除锈剂进行喷射，四人被迫逃离。其后林建新返回雷克萨斯轿车取出一瓶汽油和一把斧头，在明知张某等三人仍在车内的情况下，将汽油泼洒在现代牌轿车油箱附近并点燃，又用斧头猛劈油箱数下，欲燃爆该车。因油箱无法劈开，林建新遂将该车左后轮胎砍破，后驾车离开现场。张某舅舅等四人，在林建新离开后立即将车内的张某三人救出车外，并将火扑灭。

　　被告人林建新以为车内三人已被其烧死，为发泄私愤，又产生报复社会、制造影响之念。在驾车途经闽侯时制造了恶性撞人案。林建新在驾车逃跑其间，还撞击了一辆本田轿车，后因爆胎而停车。林建新以车内有大量汽油相威胁，与赶到的公安人员进行了一个多小时的对峙，其后公安人员强行破拆车门将林建新抓获。

　　2015年5月，福州市中级人民法院一审以以危险方法危害公共安全、故意杀人罪，判处被告人林建新死刑，剥夺政治权利终身。林建新提出上诉。经福建省高级人民法院终审裁定，驳回上诉，维持原判，并依法报请最高人民法院核准。最高人民法院经复核，依法核准被告人林建新死刑。(完)
