中国最高人民检察院督办销售假药案在滇开审 涉案金额达560余万
中新网昆明6月29日电 (张玉绒)29日，由中国最高人民检察院督办的王崇岗、王加见销售假药案在云南省曲靖市麒麟区法院公开开庭审理。麒麟区人民检察院指控，二人销售假药金额达人民币560余万元。

　　麒麟区人民检察院指控：2008年至2015年期间，被告人王崇岗为获取非法利益，销售“神奇制药厂”生产的“神奇咳喘灵”、“特效胃根治”、“颈复康胶囊”等假药。假药购买者通过电话联系到王崇岗后，王崇岗将假药从河南省邮寄给被告人王加见，再由王加见帮其储存、寄售，假药购买者则通过银行转账、汇款等方式直接将货款支付给王崇岗。

　　王加见为获取报酬，在收到假药后按照王崇岗电话或短信的指示要求，将药品通过邮寄、车带、直接送达等方式发往云南曲靖、昭通、昆明、玉溪等多地，尔后向王崇岗报销寄送费用。2012年7月至2014年11月期间，王加见帮王崇岗寄送假药共计212208瓶。

　　2015年5月28日，民警依法在王加见家中查获尚未销售的“神奇咳喘灵胶囊”、“特效胃根治胶囊”、“颈复康胶囊”等14种假药，共计2108瓶。经曲靖市食品药品监督管理局认定，上述查获的14种药品均为假药。经对王崇岗销售假药的银行账户明细统计，销售假药金额达人民币5606506元。

　　麒麟区人民检察院认为，被告人王崇岗、王加见违反国家药品管理法律法规，销售假药，其行为已触犯《中华人民共和国刑法》相关规定，犯罪事实清楚，证据确实、充分，应以销售假药罪追究刑事责任。同时，二被告人属共同犯罪，王崇岗系主犯，王加见系从犯。

　　庭审中，控辩双方围绕二人是否共同犯罪，王崇岗是否累犯，以及王加见是否属于自首等焦点问题进行辩论。王崇岗的辩护人就共同犯罪的认定及责任问题，王崇岗被羁押期间仍然发生销售所得等问题发表辩护意见。王加见的辩护人围绕其是否主观明知，主观恶性大小，销售金额所得，是否自首，系初犯等方面发表辩护意见。

　　由于案情复杂，麒麟区法院将择期进行宣判。

　　被告人王崇岗系河南省台前县人，曾因犯生产假药罪，于2005年6月9日被山东省梁山县人民法院判处有期徒刑一年，并处罚金10万元。后因涉嫌生产、销售假药罪，于2014年11月8日被河南省濮阳市台前县公安局刑事拘留，同年12月12日被河南省濮阳市台前县人民检察院批准逮捕，2015年2月9日被河南省濮阳市台前县公安局取保候审。
