金羊网讯 记者董柳报道：广东省政府原副秘书长罗欧因“好帮忙、能办事、搞得定”而被冠以“搞定哥”的称谓，为此他公然索贿、充当“掮客”、插手司法。然而，“搞定哥”也有被骗的时候，而且数额还是4008万元！一次饭局上，罗欧听到一名老板自称认识中组部领导后，为解决自己的副省级待遇问题，让这位曾行贿过自己50万元的老板帮忙“跑官”，却被骗。发觉上当后，他担心对方暴露买官的事反而不敢追讨太急。今天上午，向罗欧行贿50万元、诈骗4008万元的商人刘沃升被广州中院一审以单位行贿罪、诈骗罪判处有期徒刑13年。
厅官“跑官”被骗4008万
今年38岁的刘沃升出生于广东广州，2007年注册成立了广东润钛投资集团有限公司（简称“润钛公司”），任董事长。2011年，他经人介绍认识了广东省政府副秘书长兼省打私办主任罗欧。
刘沃升说，他和罗欧一起吃饭喝酒时，常吹嘘自己认识北京的领导，抬高自己。当罗欧问其是否认识中组部的人时，他则称认识中组部某领导，可以帮罗欧提拔为省政府秘书长。
罗欧对此表示，他听说刘沃升很有关系，在中组部有熟人，可以帮忙解决副省级待遇问题，之后将简历发给了刘沃升希望帮忙，但刘沃升说需要2000万活动经费。
2013年端午前后，罗欧找到广东一家公司的董事长关某（另案处理），要求关某帮忙出2000万元活动经费。关某则提出以担保的方式出钱，也即：让刘沃升在关某指定的贷款公司借款，由关某来做担保，如果跑官的事办成了，钱不用刘沃升还就由关某出，如果办不成，钱还可以追回。罗欧同意了。
刘沃升从关某处拿到2000万元人民币。罗欧说，约一个月后，刘沃升称提拔的事有进展了，但还需2000万元活动经费，罗欧又找了私人老板吴某锐（另案处理）以同样的方法弄钱给刘沃升。刘沃升此次拿到2008万元。再之后，当刘沃升又向罗欧要2000万经费时，罗欧怀疑被骗未再给钱。
法院一审后确认了刘沃升在2013年5月、2013年6月及9月分两次分别收到2000万元、2008万元活动经费的事实。得手后，刘沃升将款项用于偿还债务和个人挥霍。
厅官发现被骗叮嘱别追太急
“刘沃升从来没有退还过这4000（多）万元，但为了掩人耳目支付过几个月的利息后就没有再支付了。”罗欧在证言中说。
关某和吴某锐曾向刘沃升追讨，但罗欧担心追得太急怕刘沃升暴露了他买官的事情，就叫关某和吴某锐不要再逼刘沃升。
2014年5月25日，罗欧涉嫌严重违纪问题被广东省纪委通报落马。同年6月19日约20时，刘沃升在广州白云机场被纪委工作人员带走。
法院另查明，2011年至2012年间，刘沃升控制的润钛公司与清远市某单位合作开发工程项目及周边198.4亩地块，为谋取不正当利益，请托时任广东省政府副秘书长罗欧利用分管国土工作的职务便利，帮其解决这198.4亩地块的土地指标问题。事后，刘沃升为感谢和希望日后继续得到关照，于2012年春节前和中秋节前分两次送给罗欧现金共人民币50万元。而罗欧作证表示，他为此给广东省国土厅和清远市政府有关领导打过招呼。
广州市检察院在侦查刘沃升涉嫌行贿案时，发现其还涉嫌诈骗犯罪且数额巨大，社会影响恶劣，因不属于该院管辖范围，于是将诈骗线索辗转移交给公安机关。
广州中院一审判决刘沃升犯单位行贿罪，判处有期徒刑10个月，并处罚金10万元；犯诈骗罪，判处有期徒刑13年，并处罚金100万元。数罪并罚，决定执行有期徒刑13年，并处罚金110万元。
听判过程中，刘沃升不断叹气。判后，他对判决发表了异议，并当庭表示要上诉。
