答：我想再次强调指出，菲律宾南海仲裁案仲裁庭对本案及有关事项无管辖权，不应进行审理并作出裁决。菲律宾阿基诺三世政府在2013年1月22 日单方面就中菲在南海的有关争议提起仲裁。中国政府立即表明了不接受、不参与的立场。菲律宾阿基诺三世政府单方面提起仲裁违反国际法，背弃了中菲间就通过 双边谈判解决南海有关争议达成的协议，违背了菲律宾在《南海各方行为宣言》中作出的承诺，即通过直接当事国对话谈判解决争议的规定，滥用了国际仲裁机制。
仲裁庭不顾中菲已选择通过谈判协商方式解决争端的事实，无视菲律宾所提仲裁事项的实质是领土主权问题的事实，规避中方根据《公约》规定做出的排 除性声明，自行扩权和越权，强行对有关事项进行审理，损害缔约国享有的自主选择争端解决方式的权利，破坏《公约》争端解决体系的完整性，严重损害国际法 治。
在领土问题和海域划界争议上，中国不接受第三方争端解决方式，不接受任何强加于中国的争端解决方案。中国政府将继续遵循《联合国宪章》确认的国 际法和国际关系基本准则，坚持与直接有关当事国在尊重历史事实的基础上，根据国际法，通过双边对话协商解决南海有关争议，共同维护南海和平稳定。
问：据报道，美国副国务卿香农近日在印度称，在核供应国集团首尔全会上阻止印度加入的那一个国家必须为自己的行为负责。他还对中方在南海的行动进行指责，称继南海之后中国的下一个目标是印度洋。中方对此有何回应？
答：美方有关官员涉及核供应国集团的言论罔顾事实。“印度加入问题”没有列入集团首尔全会的议程 ，会议也没有讨论任何具体“非《不扩散核武器条约》缔约国”的加入问题。正如全会新闻公报所说，“会议讨论了‘非《不扩散核武器条约》缔约国加入集团的技 术、法律和政治问题’”。任何个人、任何国家都不应也不该置自己于国际规则的对立面。
对于美方官员在南海问题上的言论，我们表示强烈不满。中国在南海问题上的立场和主张非常清楚，第一是坚定维护国家主权和海洋权益，第二是坚持通 过直接有关当事方对话协商解决争议，维护地区和平稳定。美方官员有关言论妄图挑拨离间，拨弄是非，是极不负责任的。我们要求美方恪守在南海主权问题上不持立场的承诺，为维护地区和平稳定发挥建设性作用，而不是相反。
