清理整合5000项标准

姚胜委员问：在食品安全配套规章制度的建立和落实方面做了哪些工作？

历经三届人大、四次审议、酝酿十年之久的资产评估法将于2016年12月1日起正式实施，这标志着我国发展近30年的资产评估行业终于迎来首部行业大法。随着资产评估法的出台，对行业发展有何积极影响？记者采访了多位权威人士。
未来评估费用有望降低
国务院取消对有关评估师职业资格的行政许可后，资产评估法多处条款体现了行政审批制度改革精神，放开评估专业人员准入门槛，允许评估师以外的具有评估专业知识和实践经验的人员从事评估业务。
“降低行业准入门槛，有利于百姓日常生活中的融资贷款抵押、房屋拆迁补偿、农地占用补偿等需求可以更方便获得评估服务，服务的便利化也会促进评估费用的降低。”中国资产评估协会秘书长张国春说。
避免行业协会成“红顶中介”
脚踏“政府”和“市场”两只船，行业协会因为与政府扯不断、理还乱的复杂关系，常被称为“红顶中介”。如何规范行政审批，加强对行业协会监管备受关注。
资产评估法在第五章“行业协会”部分，通篇贯穿的关键词就是“实行自律管理”，强调行业协会要依照法律、行政法规和章程实行自律管理，并明确行业协会职责。
“要搞好资产评估，加强行业协会的力量非常重要。”全国人大常委会委员吴晓灵说，只有强化法律红线，促使行业协会能真正实现自律管理，才能改变以往行业协会的“二政府”形象。
目前，我国开展的资产评估服务主要涉及综合资产评估、房地产估价、土地估价、矿业权评估、旧机动车鉴定估价和保险公估单项资产评估等六大类专业，分别由财政部、住房和城乡建设部、国土资源部、中国商务部和保监会等五部门管理。
全国人大常委会法工委行政法室副主任黄薇说，鉴于我国六大评估领域各有自己的行业协会，没有一个统一的协会，法律在第37条中提出各协会间要建立一个沟通协作和信息共享机制，鼓励各协会在日常的自律管理中共同制定行为规则。
堵住国有资产流失漏洞

“资产评估法是一部守护资源价值、维护市场公平、规范资本运作的国家法律。”全国政协委员、中通诚资产评估有限公司董事长刘公勤说，在推进供给侧结构改革过程中，面对日趋频繁的国有企业的资产转让、重组、增资扩股、股权交易等活动会，需要用法律规范资产评估行为，使之成为防止国有资产流失的重要屏障。
“希望资产评估法出台之后，从业人员依法开展业务，政府部门依法加强监管，行业协会积极发挥作用，从而遏制目前有些资产评估的乱象。”全国人大财经委法案室主任龚繁荣说。
值得关注的是，新法加大了对违规评估机构和评估专业人士的惩处力度。如对违法机构出具虚假评估报告或有重大遗漏，会被责令停业六个月以上一年以下，没收违法所得并处违法所得的一倍以上五倍以下罚款；情节严重的吊销营业执照；构成犯罪的依法追究刑事责任。 据新华社
