　　原告许先生是86版电视剧《西游记》前25集中所有音乐作品的曲作者，其起诉称，2015年12月初发现被告某科技公司在未经许可、不加自己署名的情况下，在该公司创作并出品发行的游戏《新西游记》配乐中使用了原告享有著作权的《西游记序曲》《猪八戒背媳妇》两首作品，且该侵权配乐贯穿游戏始终。

　　原告认为，该侵权游戏由被告运营，并通过游戏装备充值等手段获得收益，从2014年至今，被告在涉案游戏中使用侵权作品的行为，已经构成对原告涉案乐曲作品著作权的故意侵权。故起诉要求法院判令被告停止侵权，在其官网及其他所有网络删除侵权游戏《新西游记》、在相关媒体以及被告公司网站显著位置刊登赔礼道歉声明并赔偿原告经济损失160万元。

　　被告科技公司答辩称，被告在2015年12月接到原告相关情况告知后立即对游戏及相关事项进行自查，在发现确实因为自身疏忽而未做相关授权的信息之后当即对两首涉案作品进行删除，及时停止对涉案游戏使用，已经停止侵权。且被告完全没有侵犯原告音乐著作权的主观恶意，也没有放任侵权结果的继续扩大和蔓延。

　　针对原告所说的关于署名权问题，被告表示，因为游戏软件的特殊性，将背景音乐的署名显示在软件内很难实现。同时，被告为了合法使用本案两首涉案作品，分别于2009年6月3日及2011年5月19日同音著协签订授权协议，已经从音著协处获取相关音乐授权，被告以每首曲子按照年期支付费用。
