“时间恰好是1月17日我的手机没有信号的时候，有人冒名顶替把我的手机号给‘偷’了。”李聪说，“在这个过程中，北京移动业务员在办理业务过程中并未尽到审慎的核实。”
对于李聪的质疑，记者6月30日联系北京移动咨询其在“办理补卡业务时业务流程是怎样的？是如何做到审慎的核实义务的”？
“北京移动关于客户使用临时身份证补卡的流程和规定如下：客户使用临时身份证办理补卡业务，营业厅工作人员需要通过公安认证身份证查询系统调取客户信息，与临时身份证信息进行比对，信息比对通过方予以办理相关业务。”北京移动在回复记者的采访邮件里称。
“如果比对信息严谨，为什么我的手机卡会让别人用临时身份证补办了呢？这说明移动公司业务员在比对时疏忽了。”李聪称，在望京营业厅时，自己曾亲眼看到犯罪嫌疑人提供的临时身份证显示的照片与自己明显不符。
到底是谁换了自己的手机卡？犯罪分子又是如何利用手机卡盗取了自己的财产？李聪陷入困惑之中。

1月25日，北京市公安局朝阳分局南湖派出所正式受理了李聪的报案。
李聪告诉记者，目前该案已经由北京市公安局朝阳分局刑侦科接手负责。“我曾多次打电话询问进展情况，得到的答复始终是有消息或进展会及时通知我。”
久等没有结果之下，李聪选择了另一条法律途径进行维权。
3月23日，李聪以中国移动通信集团北京有限公司为被告，以招商银行股份有限公司北京分行为民事诉讼第三人，向北京市东城区人民法院递交了起诉书。
“因为我手里掌握的证据太少，所以在律师的建议下追加了北京招商银行为诉讼第三人。主要也是希望通过北京招商银行自证拿到真实的犯罪嫌疑人转账交易的信息。”李聪说。
李聪的这一决定让他再次发现新情况。
原来，招商银行网上银行转账有两个渠道，一个是李聪常用的个人银行专业版，另一个则是个人银行大众版。这一点，记者从招商银行官网得到了证实。
“个人银行专业版需要通过‘身份证信息+短信验证+密钥’的方式才能登录和转账。而个人银行大众版只需要‘银行卡号+查询密码’即可登录，转账则直接短信验证即可。”李聪说。
记者亦在招商银行官网注意到，如果查询密码忘记，只需要通过“开户地+银行卡号+取款密码+短信验证码”就可以修改。
李聪表示，在法庭质证答辩的过程中，招商银行证实四笔共计175587元的财产是犯罪分子通过个人银行大众版渠道进行了盗刷。此外，招商银行也提供了李聪确实在2015年8月开通过短信验证码转账业务的签字合同。
记者拿到的一份转账详单显示，1月17日，犯罪嫌疑人曾尝试通过招商银行个人银行大众版渠道发起9次对李聪的招商银行卡进行转账交易，这其中成功4次。
转账交易单显示，对方交易账户为“王国民（尾号9470）”“王树梅（尾号4513）”“王清明（尾号4752）”“孟召俊（尾号4086）”，交易金额为“49000元”“48000元”“30587元”不等。
然而，疑云却再次涌上李聪的心头。
“虽然招商银通过自证证实不存在过错行为，但是犯罪嫌疑人是如何知道我的银行卡号、身份证号码这些关键信息的呢？”李聪疑惑，“我的身份证、银行卡从来都没有丢失过。这些隐私信息又会是谁泄露给犯罪嫌疑人的呢？”

6月23日，李聪起诉北京移动索赔一案终于有了结果。然而，结果却让李聪更加不解。
针对李聪的起诉，北京市东城区人民法院作出裁定认为，鉴于本案涉嫌刑事犯罪，且李聪报案后公安机关已经正式受案，因此依据《最高人民法院在审理经济纠纷案件中涉及经济犯罪嫌疑若干问题的规定》第十一条，裁定驳回李聪的起诉。
