经法院审理，王力军因违反国家《粮食流通管理条例》的规定，非法经营玉米收购，非法经营数额达到21万余元，数量较大，构成非法经营罪，判处有期徒刑1年，缓刑2年，并处罚金2万元。
对话动机：该案曝光后，舆论哗然。不少法律学者和律师对上述判罚产生了异议，认为判处非法经营罪应进行实质性审查，即王力军行为是否扰乱了市场秩序。另外，《粮食流通管理条例》也被很多学者认为存在“浓厚的旧体制色彩”。
“想凭自己的辛苦，挣点钱维持生活，没想到成了犯罪人员。”7月6日下午，王力军对剥洋葱（微信ID：boyangcongpeople）说，靠种地一年收入三万元，“供应两个娃娃紧张得厉害”，收玉米是为了补贴家用，过生活。
他称自己此前不懂法，触犯了法律，认罪伏法。

剥洋葱：总共收了多少玉米，怎么收的？利润怎么样？
王力军：我自己有一辆凯马农用车，一趟能拉十一二吨左右，一般就在我家附近方圆五六十公里的范围内收玉米。
国家粮库对玉米的质量要求高，按照玉米的质量，分一、二、三不同的价格等级收玉米。如果能交给粮库，一车能挣四五百块。如果质量不好，交给地方的淀粉厂，价钱低，只能挣二三百。我总共收了十来车玉米，跑了十来趟，赚了五六千，就是法庭上说的非法所得六千块。

王力军：是。我有个认识的人在检察院工作，就去咨询他。他说，没有粮食收购许可证、没有在工商局办理营业执照，触犯法律了，得去自首。我就去公安机关自首了。

王力军：被拘留了三天。因为地里忙，交了5000元保证金，取保候审了。后来一直在家种地，今年4月26日法院下了判决。

王力军：我平时以种地为主，之前家里种了十二三亩地，一年收入三万左右。8月份地里秋收后，农闲了就想找点“活钱”维持家用。儿子在天津学美发，已经20岁了，也想着给他盖房娶媳妇。
所以2014年秋收之后，就贷款2万块买了玉米脱粒机，2014年11月开始收玉米。
剥洋葱：玉米的行情怎么样？
王力军：一斤玉米赚2分钱左右，比如2014年国家粮库的收购价是一块一毛七，我们下去收，根据农户玉米的质量，给他们的价格是八九毛左右。有时候因为玉米水分、杂质或者发霉的问题，粮库给的价格低，甚至拒收，我就赔了。
冬天走村串户收玉米，一个人要拿叉子把玉米棒子放到机器里，脱粒出来装袋，然后拉去粮库。不过还是比较容易收，有的农户说我们是为农民服务。
剥洋葱：像你这样无证收粮的情况，之前有见过吗？
王力军：我们这个地方以种玉米为主，还有个玉米培育基地，收玉米的大概有几千人。我没见过别人拿出证来收玉米。
粮库交玉米的地方也排队，多的时候要排三四天才能交上一次，好几千挂车一起排队。冬天，车里没有暖风，住不住人，后半夜就跑到旅馆里挨一挨。因为交玉米的人多，还有人专门开着面包车在附近卖烩菜、焖面。
剥洋葱：你自始至终都不知道收粮需要办理相关手续吗？
王力军：2015年3月份被举报之后，我想着如果没证不让收玉米，贷款买的机器就浪费了，也去办过证。但是手续很多，要求有固定的场所、收购点，要有注册资金，我一个农民是办不下来的。现在那机器只能在院子里闲放着。
“种100亩玉米才能赚回来”

王力军：从4月26日开始，每个月一边种地，还要到司法所面谈一次。每个礼拜要打电话汇报行踪。这个周一刚去了司法所，所长讲解了一些法律知识，让我汇报了思想情况。

王力军：觉得我这个事不应该判刑。之前不懂法，想凭自己的辛苦，挣点钱维持生活，没想到成了犯罪人员。
剥洋葱：你在法庭上的认罪态度挺好。
王力军：以前不懂法，触犯了法律，我认错。从我心里来说，我觉得这样处罚对农民是无利的。平常下去收玉米，很多种地的都是六七十的老人，他们自己拉不动玉米，少卖一分二分钱把玉米交给我们，我们拉去粮库上交，我们能挣口饭钱，他们也比较方便。我们干的时间长了，还能跟农户随时沟通玉米价格。原来我走的一些村子，对我评价还挺好，说我是“为人民服务”。
