一份网络流传的产煤大县——陕西省府谷县政府向陕西前首富高乃则名下公司借款6亿元的合同，引起广泛关注。
《每日经济新闻》记者查询府谷县国有资产运营有限责任公司（以下简称府谷国有资产公司）2015年报证实，截至2015年12月31日，高乃则名下两家公司向府谷国有资产公司合计借款6.53亿元。
此前《每日经济新闻》报道过，上述两家公司实际控制人高乃则的财产已经被全部查封，且已进入评估拍卖程序。高乃则再曝向政府借款，且偿还延期无疑值得关注。
6.53亿借给高乃则名下公司
网络流传的这份借款合同签订时间为2014年7月23日，签约双方为府谷县国有资产运营有限责任公司与陕西兴茂侏罗纪煤业镁电（集团）有限公司（以下简称兴茂侏罗纪）。
府谷国有资产公司的唯一股东为府谷县政府，而兴茂侏罗纪则是高乃则个人控股的公司。值得注意的是，该公司也是高乃则旗下诸多公司的实际控制公司。
兴茂侏罗纪向府谷国有资产公司借款6亿元，用作后者流动资金周转，约定借款期限为6个月，即2014年7月23日起至2015年1月22日。双方还约定，借款利率以府谷国有资产公司获得该笔6亿元资金的成本利率计算。
《每日经济新闻》记者注意到，这份流传的借款合同有府谷国有资产公司法人“张峻墚”和兴茂侏罗纪法人代表“高乃则”的签名字样，以及一枚公章的印记。
记者查询府谷国有资产公司2015年报，印证上述合同属实。截至2015年12月31日，该公司应收账款一栏，高乃则旗下两家公司欠府谷国有资产公司合计6.53亿元。
其中一家正是兴茂侏罗纪，欠款额为6亿元，性质为暂借款，借款额和借款时间均与上述合同吻合。另一家借款公司——府谷煤业集团有限公司是以高乃则为大股东的煤炭公司，该公司亦从府谷国有资产公司借款5310万元。
对于高乃则名下公司向府谷国有资产公司借款6.53亿元一事，记者向多名与上述借款相关部门和人士核实，不过都不愿就上述问题过多回应。
《每日经济新闻》记者致电府谷国有资产公司，一名办公室工作人员称：“不大清楚，领导都不在。”兴茂侏罗纪办公室一名相关人士亦不愿意提及此事：“不知道。”
府谷县政府办一名工作人员从侧面向记者证实了该借款事件，他称：“这件事情（府谷县）财政局在负责。”但府谷县财政局电话一直无人接听。
随后记者多次致电时任府谷县长辛耀峰，但对方电话一直无人接听。
借款已经逾期1年
陕西树理律师事务所律师王洋对记者称，一般来讲，企业与企业之间不能有直接的借款行为，除非出借方有金融许可资质。
记 者注意到，2009年4月15日出台的《府谷县国有资产运营有限责任公司资产运营管理办法》显示，该“办法所称运营管理是指运营公司对外投资；对外出租企 业经营权，对外出借资金”，依照该办法所述，出借资金在府谷国有资产公司经营范围内。上述《办法》称，对外出借资金注意防范风险，落实担保、抵押、质押等 反担保措施，对不良债务及时预警。
这就是说，外借国有资金监管不严，造成的损失便属于国有资产流失。事实上，《每日经济新闻》记者了解到， 在上述借款合同签订之前，高乃则旗下多个公司股权均已被质押。此外，府谷国有资产公司借给兴茂侏罗纪的6亿元到期时间是2015年1月22日，然而依照上 述府谷国有资产公司年报显示，截至2015年12月31日，这笔钱尚未归还。
此外，《每日经济新闻》记者在一份“西安市中级人民法院执行裁定书”中注意到，高乃则及其参股的府谷煤业集团有限公司名下财产已全部被法院查封，且已进入评估拍卖程序。
记者了解到，作为国内排名前列的产煤大县，府谷以民营企业发展快、数量多著称，个人之间、公司之间的资金拆借极为普遍，不过当煤炭价格持续下滑，煤炭经济陷入困境，难以如期还款频繁出现。
高乃则旗下的兴茂侏罗纪是府谷县最大的民资企业。然而，现在高乃则窘迫的财务状况，或许会成为上述借款顺利兑现的“绊脚石”。
