　　中新网昆明7月8日电 (王艳龙)8日下午，云南省高级人民法院召开钱仁风申请国家赔偿案听证会，就再审改判钱仁风无罪申请国家赔偿一案举行听证会。钱仁风及其代理律师与云南省高级法院组成的赔偿委员会就赔偿等事宜进行听证。

　　钱仁风的代理律师杨柱此前表示，他们之前在与云南省高级法院相关负责人会面过程中提出，国家赔偿数额既要体现个案的具体情况与人性关怀，更要能推动促进国家对受冤者补偿的制度化构建。同时，希望联合调查组尽快调查抓捕真凶，彻底还钱仁风清白。相关方表示，决不会包庇真凶。

　　钱仁风，又名钱仁凤、钱仁研，女，1984年，汉族，小学文化，云南省巧家县人，农民，原住云南省巧家县崇溪乡南团村钱梁社。

　　2002年7月22日，云南省昭通市人民检察院以钱仁风涉嫌犯投放危险物质罪向昭通市中级人民法院提起公诉。昭通市中级人民法院于2002年9月3日作出刑事判决，认定：钱仁风于2001年9月到巧家县新华镇朱某开办的“星蕊宝宝园”做工。做工期间，钱仁风认为朱某对她不好，遂生报复之恶念。2002年2月22日12时许，钱仁风将其从家中带来的灭鼠药投放在该幼儿园内的部分食品中，并将放有灭鼠药的食品拿给该园的部分幼儿食用，致使候某中毒后经抢救无效死亡，谭某、何某某中毒后经抢救治愈。据此，以投放危险物质罪，判处钱仁风无期徒刑，剥夺政治权利终身。

　　宣判后，钱仁风不服，提出上诉。云南省高级法院于2002年12月5日作出刑事裁定，驳回上诉，维持原判。上述裁判发生法律效力后，钱仁风被交付云南省第二女子监狱服刑。

　　服刑期间，钱仁风不断申诉，云南省高级法院2011年亦驳回其申诉。随后，云南省人民检察院建议云南省高级法院对本案再审。云南省高级法院于2015年5月决定，由云南省高级法院另行组成合议庭进行再审。

　　2015年9月29日，云南省高级法院开庭再审此案。同年12月21日，云南省高级法院以原判认定钱仁风犯投放危险物质罪事实不清，证据不足，故再审宣判钱仁风无罪。

　　今年6月1日，钱仁风向云南省高级法院申请赔偿，要求赔偿义务机关支付受害人国家赔偿金9553043.65元。其中，赔偿侵犯人身自由的国家赔偿金5846699元；赔偿精神损害抚慰金2046344.65元；赔偿近14年申冤费用1660000元。

　　云南省高级法院于当日接收了其国家赔偿的申请及相关材料。经云南省高级法院审查，其提交的国家赔偿申请程序上符合《国家赔偿法》和《最高人民法院关于国家赔偿案件立案工作的规定》，于2016年6月3日依法对钱仁风的国家赔偿申请登记立案，并立即启动国家赔偿程序。依照上述国家赔偿案件立案工作的规定，云南省高级法院于2016年6月6日向赔偿请求人钱仁凤送达了《受理案件通知书》。(完)
