  投资者表示,自己并未进行网上购物,资金就这样消失,显然无法解释。有律师指出,第三方支付公司当然应该向支付人透露将向谁付款,以及数额、方式等。如果未接到指令就拨付,显然已经侵害了支付人的财产权。


  不过广州银联发布澄清声明称,公司从未截留、侵占、挪用任何客户资金,也从未涉及任何违 法犯罪活动。关于相关文章反映的当事人纠纷,经查询系当事人通过互联网进行操作,并主动通过网银使用本人数字证书(Ukey)发起支付,使用数字证书可以 准确确认本人身份及交易金额,具有不可抵赖性,相关交易资金也已全额支付给商户。

  赵海等多名投资者向本报记者讲述称,他们于2015年10月通过一家网站购买了汇邦资本的“智赢天下”贵金属交易理财投资产品,该平台要求投资者最 少以1万美元开户,运用自动化交易软件,通过国际外汇现货黄金交易获得收益,并通过MT4(市场行情接收软件)可以看到投资者对应的账号信息的变化,投资 者无法进行操作。


  值得注意的是,部分投资者无意中在银行的回单中发现诡异之处。根据赵海提供的一份电子银行回单显示,这是一份网上购物回单,收款人为“广州银联网络支付有限公司客户备付金人名称”,商品名称为“中汇商务网上支付”,支付金额约××万元。


  赵海认为,自己并未进行网上购物,也并未得到名为“中汇商务网上支付”的产品或者服务,资金就这样消失,显然无法解释。“即便是我投资了汇邦资本的理财产品,那也应该显示我们的资金被划拨给了与汇邦资本相关的企业公司,而不是以购买商品的形式流入到其他公司。”


  上海融孚律师事务所律师张烽指出,广州银联网络支付目前已经涉嫌违约。“第三方支付公司当然应该向支付人透露将向谁付款,以及数额、方式等。如果未接到指令就拨付,显然已经侵害了支付人的财产权。第三方支付公司与支付人之间有账户协议,所以,更确切来说,算是违约。”


  对于商户信用审核风险方面,业内人士分析称,第三方支付平台不会主动去对接口企业进行风险审核,甚至包括企业的真实性。作为第三方通道来说,支付平台可能会基于道德压力进行资金追回,但是绝对不会承担法律风险。


  7月4日上午,广州银联在官网刊登声明,就此事特此澄清。声明中表示,“广州银联网络支付有限公司从未截留、侵占、挪用任何客户资金,也从未涉及任 何违法犯罪活动。关于相关文章反映的当事人纠纷,经查询系当事人通过互联网进行操作,并主动通过网银使用本人数字证书(Ukey)发起支付,使用数字证书 可以准确确认本人身份及交易金额,具有不可抵赖性,相关交易资金也已全额支付给商户。”

  3月18日上午11:33,正在上班的关女士突然收到了银行发来的提醒短信,称她的一张储蓄卡里支出0.38元,短信中说是基金费用。还没等她反应 过来,手机又收到了一条短信,称其卡中又以同样的项目扣款3000元。因为扣房贷的时间还没到,自己也没有进行任何支付或提现的操作。关女士立即跑到银行 网点查询,发现钱的确被划入广州银联网络支付有限公司客户备付金的账户中。


  关女士随即致电对方账号所属公司的客服中心,得知这两条短信扣款其实并不是一家公司所为,而是被平安银行旗下两家北京的基金公司转走。而且在她之 前,客服中心也接到过类似投诉情况,但由于是商户直接与申诉人解决,所以她们也不清楚最后的解决情况。不过,客服中心表示会将申诉意见转达,让对方尽快回 复。


  针对关女士的情况,开卡银行个人客户部的工作人员称,他们已经在积极与第三方平台联系解决问题。而市民可以先在附近网点工作人员的协助下,先按“三步走”的方法进行申诉。


  第一步,便是到附近网点打印银行卡客户交易查询单,再拨打银行人工客服,对其说明情况,告知查询单上交易时间、对方户名、账号等信息,等待人工客服 查询后发来短消息。第二步,拨打短信内容所提供的对方账号所属公司的客服中心号码进行申诉,表示之前没有任何交易,对被“扣”资金申请赔付,等待客服查 询。第三步:到派出所报案,拿受理回执,以及准备客服要求的相关材料。


  因备付金账户扣款问题 广州银联商誉受损

  广州银联因备付金账户扣款问题,频遭网民非议。《中国经营报》报道称,据中国电信旗下聚投诉网站的投诉信息显示,今年5月份,曾有用户反映,自己银行账户的钱通过广州银联主动划拨至平安人寿保险,而该用户并未购买平安任何理财产品。


  中国经济网记者登录聚投诉网站,在搜索一栏输入“广州银联” ,出现了52条搜索记录。陆续有用户投诉“账号被广州银联网络支付有限公司客户备付金无故扣款”的事件。投诉人刘先生反映,发现银行卡在3月31日被广州 银联网络支付有限公司客户备付金划走5448元。吴女士于3月13日发布投诉称,“本人在不知情的情况下,收到银行扣费短信,该资金流向为‘广州银联网络 支付有限公司客户备付金’。”


  但中国经济网记者未收到广州银联相关人士回复,刘先生与吴女士投诉信息真实性有待进一步确认。
