  保护农用地不被侵占是国土资源管理部门的使命。然而,在广东省阳江市,一宗数万平方米农用土地在被非法征用过程中,8年来当地国土部门连下4道土地行政处罚决定书,非法征地行为不仅未得到阻止,相反占地面积却越来越大。


  记者调查发现,面对行政处罚,当事人一边认罚一边继续违法,当地国土部门却一直按每平方米1元钱予以罚款。如此荒唐的执法囧事为何会发生?


  国土部门4次叫停 一边认罚一边违法


  2007年2月,个体老板洪万来与阳东县东城镇房地产开发公司签订《代征土地协议书》,征用该镇金村村委会西坑一带10余万平方米土地,明确由东城房地产公司负责报批该宗土地,协助理顺相关职能部门关系,而洪万来负责征地补偿等一切费用,以及按规划要求平整土地。


  由于涉事土地为农用地,根据我国《土地管理法》等相关规定,征用土地必须经相关政府部门批准,取得农用地转为建设用地批准文号后才能对土地实施征用。土地的征用必须由市、县人民政府组织实施。这意味着洪万来与东城房地产公司的代征地协议一开始就是非法的。


  就在洪万来开始推土时,广东省国土厅通过卫片执法发现了这一问题,并要求阳东县国土局跟进处理。2008年10月25日,东阳县国土局同一天出具了两份土地行政处罚决定书。


  面对处罚,洪万来按要求交了罚款,也复耕复绿,但他并未停止非法征地行为。数据显示,洪万来在被处罚之后依然将征地赔偿款支付给东城房地产公司。如2009年2月20日支付了135万元、2009年4月28日支付了144094元。


  2010年3月21日,阳东县国土局作出第三张土地行政处罚决定书。与之前如出一辙,洪万来认罚,但事后依然“我行我素”,进而在涉事土地上建设起多栋建筑物。


  由于阳东县在2015年改制为阳东区,同年5月21日,阳江市国土局作出第四张土地行政处罚决定书。记者调查发现,8年来,当地国土部门连下4道“处罚令”,不仅未能从一开始就阻止洪万来违法征地,反而在一边处罚一边违法的拉锯过程中,7万多平方米土地被堂而皇之征出来。如今涉事土地被洪万来用高大的铁皮围墙团团围住,外人无法进入。从一路之隔的民房顶楼望去,可见多栋建筑物和水泥桩,一条用水泥铺就的大马路横穿整片土地。


  占地有恃无恐 处罚每平方米1元钱


  记者调查了解到,涉案土地在2012年才经广东省政府批准由农用地转为建设用地。在未取得土地使用权的情况下,洪万来竟然荒唐利用非法占有的上万平方米土地成立了“万来园林绿化工程公司”,经营范围包括园林绿化、花圃种植、销售园林花草树木。洪万来为何有恃无恐?


  处罚隔靴搔痒是重要原因。记者在前三份决定书上看到,洪万来从2008年至2010年非法占有土地面积为26357.8平方米,而罚款也为26357.8元,罚款标准仅为1元/平方米。对此,阳江市阳东区国土局相关负责人如此解释,根据国家相关规定,对未经批准非法占用土地,处非法占用土地每平方米30元以下罚款,“1元钱符合国家处罚标准”。


  更难以置信的是,当地国土部门竟然对这样的违法占地行为无计可施。当地国土部门称,从2008年开始,阳东区政府也多次组织城管、建设、国土等综合执法力量前往现场强拆,但最后都不了了之。


  根据中华人民共和国《土地管理法》相关规定,对非法占用土地行为的处罚方式,除了罚款、恢复土地原状外,还需责令退还非法占用的土地,但前三份处罚决定书却未提及。对此,阳东区国土局执法人员却回应称:“围墙是后来才建的,当时洪万来既没有围闭土地,也没有在土地上建房子,我们很难界定其是否占有土地。”


  有律师认为,所谓占有就是享有对土地的收益权。建围墙只是占有土地的一种表现形式。洪万来利用涉事土地搞园林绿化经营,其本质就是对土地的占有。正是因为没有责令让其退出非法占有的土地,留下隐患。


  “文书式”执法只做样子 防违法须加大问责


  目前,《代征土地协议书》已被当地法院判决为无效协议。面对这起一开始就违法的征地行为,表面看来,当地国土部门按相关法律程序下发了土地行政处罚决定书,不可谓不“尽职尽责”。


  然而,事实果真如此吗?在阳江市国土局作出第四份处罚决定书之后,洪万来不服向广东省国土厅申请复议。2015年9月23日,广东省国土资源厅听证后认为,虽然阳江市国土局对洪万来非法占用土地行为的认定,定性准确,但未能举证证明洪万来的非法占地建房行为是在2010年第三次行政处罚后新发生的违法行为,因担心同一违法行为重复处罚撤销了第四份处罚决定书。


  涉事土地离阳东区国土局距离并不远,洪万来的违建行为可谓在国土部门眼皮底下进行,而当地国土部门在其长时间的违建过程中竟然没有前往取证,令人不可思议。


  阳江市一人大代表认为,当地国土部门不断下发处罚决定书,白纸黑字看起来似乎是依法行政,各项程序完备,但细细梳理会发现,这种“文书式执法”只是做做样子,不敢硬碰硬,其本质就是一种“惰政”“懒政”,执法窘态显露无遗,影响了法律权威。


  阳江市阳东区国土分局执法大队不愿具名的负责人也坦承,阳东区国土分局除了领导班子成员由阳江市国土局决定外,整个分局的人财物都由同级政府说了算,很多时候对某些项目就只能睁只眼闭只眼。


  广东省国土厅党组成员、执法局局长李师表示,一些党政领导干部在建设工业园区、上马重点项目征地时,存在“重发展、轻依法”的现象,常常抱有“因公违法”可以原谅、可以不追究的想法。要防止土地违法,关键是要加大对党政领导的问责力度。(完)
