　　在诚信日益重要的今天，为何部分网店耍起了赖皮？消费者维权难，难道网络平台和执法部门也拿它们没办法？记者调查发现，网店假货横行，背后竟隐藏着巨大的灰色产业链。执法部门想要查处，却也显得力不从心。

　　网店屡屡爽约 消费者无可奈何

　　许多人都曾在网购中碰到过以次充好、实物与描述严重不符的情况，更糟糕的甚至遭遇网店诈骗。然而事发后，消费者通常遭遇维权困难的窘境，并且因单个涉案金额较小而无法在中国公安部门立案，难以通过法律途径解决问题。

　　广州市民郭女士最近很烦恼。今年4月，她在网店“幻想空间家居”定制了售价38500元的整套欧式家具，并线上预付了1.1万元定金，随后卖家邮寄多块真皮皮样供买家选样。

　　6月4日，郭女士接到物流电话，称受卖家委托代收包括4000元物流和送装费在内的31500元尾款，并坚持只有在付清尾款后才能送货。当郭女士质疑售后维权问题时，物流方坚称直接找网络平台或卖家即可，并表示当地家具行业很多都采取此类线下交易的方式收取尾款。

　　郭女士立即与卖方沟通，卖方坚称自己用的是真皮而非假皮，颜色不符系每批皮料存在色差，尺寸不达标和款式不符均系定制误差在所难免，并宣称自己很忙，没功夫理会买家的挑剔要求，最多赔偿500元了事。

　　记者调查发现，类似郭女士的网购“囧途”很多人都曾遭遇。一些网购达人告诉记者，经常在网购中碰到“宣称是正品到手却是仿品”的情况，幸运的消费者还能够退货或退款，另外一些消费者只能自认倒霉。

　　更有甚者，一些网店还涉嫌诈骗。重庆市消委会收到的大量消费者投诉显示，有不少网店收到货款后突然“人间蒸发”。后经消委会调查，这类网店多为恶意欺诈，但由于单个涉案金额较小，一般为几百至两三千元，无法在中国公安部门立案。

　　低价招聘兼职 大量注册网店

　　网购乱象为何如此普遍？重庆市工商部门近期查处的全国首例网店虚假认证案揭开了其中“猫腻”。一些公司利用网络平台注册审核漏洞，大量招聘兼职人员，利用其真实身份注册网店，并转手倒卖给他人。

　　不久前，重庆一高校学生小王找到了一份兼职。单位让他利用自己的身份信息，在某网络购物平台上注册了一家网店，然后给了40元钱报酬，并表示认证成功后，还可以给更多的钱。小王不知道，自己不知不觉间，已经成为灰色利益链条中的一环。

　　近日，重庆市南岸区工商分局、南岸区公安分局联合对这家名为重庆宇佳盛信息咨询有限公司（以下简称重庆宇佳盛公司）的单位进行了查处。该公司在短短半年时 间内招聘数百名兼职人员，在某网络购物平台上注册500多家网店，然后以80至200元的价格，转手倒卖给福建莆田等地经营者。

　　记者查询工商部门登记信息发现，重庆宇佳盛公司成立于2013年，原本的经营范围为商务信息咨询、企业营销、软件技术推广及服务等，那么该公司缘何做起了网店注册、倒卖的生意？

　　“一次，我加入一个QQ兼职群，群里有个福建商人专门收购网店，我将注册的一个网店卖给了他，感觉这种方式赚钱快，也不犯多大个事，于是打定主意专门注册网店，再转手倒卖。”该公司法人牟某称。

　　注册网店，需要身份认证，也就需要大量的个人信息。为了找到足够的个人信息来注册网店，重庆宇佳盛公司在学校、社区和网络上发布大量兼职广告：兼职者只需带上身份证、银行卡，手机能够正常拍照和视频，工作一天就可获得40至130元不等的收入。

　　据成功应聘的大学生小王介绍，重庆宇佳盛公司给兼职人员每人提供一个邮箱，并指导他们用真实身份和银行账户注册网上店铺。“我们只负责注册和认证，不清楚店铺去向，更不知道这些用自己身份信息注册的网店，最后到底做什么用。”小王说。

　　倒卖网店牟利 售假诈骗猖獗

　　明明可以正当经营的企业，为何选择抛弃老本行，做起了“挂羊头卖狗肉”的生意？工商部门调查发现，网店虚假认证的背后，隐藏着一条条巨大的灰色产业链。在催生了网店倒卖的同时，网店虚假认证也给销售假冒产品、网络诈骗提供了便利，并助推了信息的非法倒卖。

　　第一条产业链：销售网店牟利。据牟某透露，短短半年内，他认证的500多个网店被销售过半。据办案人员介绍，这些网店的价格少则几十元，多则数百元。

　　记者调查发现，当前网店销售已经成为一种红火的生意，并且催生了很多专门从事网店买卖的网络平台。记者在一些网店平台上看到，一般一个五钻的网店价格在5000元以上，而皇冠网店的价格则可高达数万元。

　　一位业内人士表示，正是由于网店买卖红火且价格居高不下，才出现了疯狂的“刷单”、“炒信”等行为。目前，一些网络平台积极规范了网店交易行为，多要求交易者变更网店注册身份信息，但很难全面、严格地得到执行。

　　第二条产业链：假货“借壳上市”。工商部门调查发现，这些网店多数被用作了销售假冒产品。“购买者涉嫌利用这些网店销售高仿服装、鞋帽等商品。”重庆工商部门一位办案人员表示，消费者买到假货后，由于找不到真实的店主，通常维权困难。

　　据重庆工商部门办案人员介绍，根据对重庆宇佳盛公司电脑硬盘的数据挖掘，发现其出售的两个网店涉嫌诈骗，目前正在对其进行侦办。

　　第四条产业链：信息倒卖猖獗。工商部门调查发现，由于“虚假认证”市场需求很大，也直接推动了手机黑卡、公民身份信息的非法倒卖。一些不法分子大肆买卖银行卡、身份证、网盾、手机卡、开户信息等相关资料，形成收购、销售、使用“一条龙”。

　　记者在QQ搜索里输入关键词“证”，立即出现了大量办证服务提供者。其中一个网名为“办证”的人告诉记者，不需要购买者提供任何资料，就可以办理姓名和身份证号码一致的高仿身份证，每个身份证收费200元，而利用这些身份证，恰恰可以注册网店。

　　市场监管困难 亟待完善制度

　　记者调查发现，由网店倒卖而引发的假货横行、网络诈骗等行为，虽然损害了消费者权益，并严重危害了电子商务生态，但由于相关法律法规方面的缺失，网店实名制难以有效落实，因而给工商部门的市场监管工作带来极大挑战。

　　重庆南岸区工商分局相关负责人说，工商部门在监管中早已发现此类网络店铺虚假认证的行为，但苦于难以核实真实经营者的身份、查找到真实的违法嫌疑人。

　　“‘虚假认证’之所以有广泛的市场，其根本原因就是现有法律法规没有强制网店办理工商登记，造成网店实名制无法落到实处。”这名负责人表示。

　　据介绍，某网络购物平台上注册网店，只需要填写身份证号、电话、银行卡等个人信息，就能注册成功，而实际开店者与注册者是否为一人，则无法进行验证。

　　记者了解到，近年来国内各大电商平台针对自身业务特点和安全需求，都在积极开展以实名制体系为基础的网络身份管理工作。但虚假认证正是瞄准了实名制的“七寸”，使账号认证信息“实名”，而使用者却另有其人。

　　对此，阿里巴巴方面表示，对于以虚假注册、虚假认证为代表的互联网灰色产业链，一直保持“零容忍”的高压态度，阿里巴巴将积极配合各地执法部门，主动提供“虚假认证”团伙线索，协助执法部门进行严厉打击。
