华商报讯（记者 陈思存）一处有着租赁合同的厂房，被人连夜拆除用作停车场。蓝田县公安局洩湖派出所出具文书称，是洩湖镇政府雇人干的。该镇党委负责人称，不知这块地还有主。
承租厂房被人莫名拆了
“我回来后发现里面的厂房被推平了，整个院子也被围了起来，一打听才知道是蓝田县洩湖镇政府让人干的。”日前，今年50岁的焦建宏提起去年7月遭遇的厂房 被拆事件，仍是一脸茫然。他说，2014年5月19日，他与蓝田县食品公司签订了一份《蓝田洩湖食品站场地及房屋租赁合同》，承租了蓝田洩湖食品站 4593.5平方米场地和646.32平方米砖木结构房屋，租期5年，当时一次性缴纳了5年租金15万元，合同规定承租期满后要将场地及房屋原样归还。
焦建宏说，承租后他原本准备办养殖场，但因资金问题，这处厂房一直闲置。2015年7月他从外地回来时发现，自己承租的厂房和场地已被人用墙围起来，与一 墙之隔的蓝田县洩湖镇政府后院相连，里面停放着该单位职工的车。一打听才知是洩湖村村民李某及其儿子拆的，找到这两个人后，他们称是镇上让干的。问镇上干 部，对方说不知道是谁干的。
派出所出文称是镇政府干的
“当时镇政府不承认是自己干的，但为什么要将我的场地与他们的后院连起来呢？”焦建宏说，他拿着租赁合同以及这块场地的房屋产权证报了警。
在多次要求警方立案情况下，今年5月11日，蓝田县公安局洩湖派出所出具了一份答复：经调查，2015年7月，蓝田县洩湖镇政府为了环境治理，雇李某父子俩平整了蓝田洩湖食品站残损房屋，该镇政府整治环境、平整房屋属于政府行政行为，无犯罪事实……不予立案。
于是，焦建宏又到蓝田县检察院控申科，对公安机关答复的李某父子损害公私财物不立案一事，申请检察院立案监督。6月29日，蓝田县人民检察院答复称：“经审查查明，本案无公安机关不予立案决定书，不符合立案监督条件，故对立案监督申请不予支持。”
被平场地已经杂草丛生
7月8日上午11时，华商报记者在现场看到，原先被圈起来的场地被推倒一大块，整个场地内杂草丛生，到处堆着生活垃圾。
焦建宏说，这面墙是自己让人推倒的，因为镇政府让人拆了厂房竟称不知情，事后又把自己后院重新砌了起来。
蓝田县公安局洩湖派出所值班领导称，焦建宏手中的那份答复是该所出具的。但为何不出具《不予立案书》，他称该所不做解答。
蓝田县食品公司经理吴某表示，该公司与焦建宏签订的租赁协议目前还在有效期内，谁拆了厂房他们也不知情，也没有人给他们打招呼。
镇党委书记：
拆完了说是他人承租的
针对蓝田洩湖食品站场地及房屋被拆一事，7月8日上午，蓝田县洩湖镇党政办工作人员称不清楚这件事。随后，华商报记者电话联系到蓝田县洩湖镇党委书记沈某，他说，因旁边的厂房闲置也无人看管，且快成危房，所以就让村民给拆了，不知这块地还有主。
但对是否清楚这块地产权问题，沈某说，应该是村上的，拆除时没有人说，拆完了冒出了这块地是焦建宏承租的。
陕西众邦律师事务所李小东律师认为，按照物权法，对于合法承租国有土地上建筑物构筑物，承租人拥有合法的产权，作为镇政府，在确定拆除占用时应当尽到必要 的注意义务，以落实相关权利人，至于在目前非城市以外不动产租赁登记尚未普及的情况下，应当对经确认合法承租人承租或修建的地上建筑物进行赔偿。
