　　据报道，广东省阳江市一宗数万平方米农用土地被非法征用，8年来当地国土部门连下4道土地行政处罚决定书，非但未能阻止该行为，反而占地面积却越来越大。调查发现，当地国土部门一直按每平米1元钱予以罚款。

　　违法占用农地，开出的罚单只低至每平米1元，如此轻描淡写的处罚，几乎是对不法行径的变相鼓励。

　　对于这个近乎儿戏的“罚单”，阳东区国土局解释称，按照法律规定，对非法占用土地处每平米30元以下罚款，“1元钱符合标准”。此番说辞看似循章引据，实则让人哭笑不得：难道30元以下的限额，就非得意味着，低至1元的象征性罚款吗？要知道，行政处罚所具备的自由裁量空间，绝不是为了给违法者大开方便之门。如若罚单每每“就低不就高”，又何以惩戒不法？

　　另一个备受诟病的问题在于，国土局并未责令当事方退还非法占用的农地。这一举动，无异于是承认了“土地使用权变更”的既成事实——土地执法非但没有制止违法行为，反而起到了“将之合法化”的作用。

　　对于一起违法事实清楚、适用法律明确的土地违法案件，当地职能部门所表现出的犹豫不决，总归耐人寻味。

　　土地执法，本应基于最纯粹的专业精神。一旦其中夹杂了暧昧的利益计算，而变得畏首畏尾，那么势必会造成恶劣的示范。“1元罚款”显然就是其中一例。
