2005年3月，小邓的父亲在惠城区水口镇（即现今水口街道）购买一处房产，2006年5月全家人入住后，2007年6月，某公司惠州分公司在距离小邓居住楼不足五米的地方建造了通信发射基站。2011年起，原本健康的小邓开始出现时常会自言自语、凭空想象等异常现象，而且学习成绩也逐步下降，经惠州市第二人民医院检查治疗后确诊她患有中度精神分裂症。

医院在排查患病成因过程中，排除了患病家属遗传基因的因素。此后，小邓的父母便把怀疑重点放在了与小邓居住的房间仅有一墙之隔的某公司的基站发射台上。小邓的父母认为女儿患病应该与基站的辐射有关，因此不断向政府各部门进行投诉强烈要求把基站搬走，并上诉至惠城区法院，要求该公司赔偿小邓医疗费、精神损害抚慰金等共计4万元。
被告某公司惠州分公司应诉称，涉案发射基站是依照特定程序审批、建设并通过验收的。且经两次现场检测，其辐射标准在国家以及行业规定的标准范围，对人体的人身安全不会构成威胁。该公司不存在侵权行为，无需承担环境污染责任。
惠城区法院一审判决认为，某公司惠州分公司基站的建设及后期扩建均经原省环保局（即现今省环保厅）批准，完工后批准同意通过验收，同时分别于2013年、2014年进行了两次检测，两次检测结论均为电磁辐射水平符合国家环境保护法法律规定，未超过《电磁辐射防护规定》相关标准。原告小邓认为检测结论不符合客观事实，也没有在法定期限内申请复查。且法庭询问原告所住附近是否有其他人员患有该疾病，原告表示没有。原告也无提供明确诊断证明小邓的精神分裂症是何原因导致，缺乏电磁辐射给小邓造成损害的依据。最终，惠城区法院判决驳回原告小邓的诉讼请求。
判决后，原告小邓不服判决，向惠州中院提出上诉。惠州中院经审理后，依法维持原判。
