  核心提示丨郑州“皇家一号”,曾是高端夜总会的代名词,因涉嫌色情违法行为,开业仅1年多,被河南警方“异地用警”查处。从2013年11月至今已尘封2年9个月,昨日“皇家一号”的家具和设备突然被货车拉走变卖,室内装修也被拆除。这里将经历一段为期半年的装修期,年底将改建成一个大型商场。

   昨日上午9时许,大河报记者来到郑东新区CBD商务内环与商务东四街交叉口附近,这里距离国际会展中心只有一路之隔。曾经的“皇家一号”位于路口东侧,是一处低矮的商业楼,周围都是高层写字楼。大门门廊正上方的四个大字已被抠掉,从墙上留下的痕迹仍能辨认出“皇家一号”字样。门外停着一辆搬家公司的货车和3辆三轮电动车。不断有工人进出,抬着沙发、茶几、各种装修材料等。


  大厅内,金碧辉煌的楼顶和墙体以及各种灯饰等都还没有拆除,大厅东侧的一处1尺高的平台正在拆除。在切割、拉扯、装卸等杂音交响中,东北角一名工人拿着大锤对着室内非承重墙猛砸,已砸出一个大窟窿。很显然,这里正进行大规模拆除。


  这里地下两层,地上三层,总面积约1.3万平方米。大河报记者来到地下一层,这里各个KTV包间内,原有的沙发、茶几、音响等都保存完整,屋顶吊灯发着金黄色的光,墙壁上的灯光从镂空处射出,一副金碧辉煌的模样。如果不看紧锁的房门,设备上布满的灰尘,很难猜出这里已经尘封了2年零9个月。


   调查:豪华设备当“破烂”卖


  在大堂西侧走廊入口处,一处标着“宏信置业”的包间,仍保持着原来营业时的模样。点歌设备、墙上的两台液晶电视等都还能用,屏幕上暂停着刀郎的《冲动的惩罚》的mv画面。“这些灯都是专门定制的,音响设备一套七八万,沙发、茶几都是高档货,按照我们的估算,这间打包装修下来,花费不低于50万元。”河南永森物业服务有限公司的张永利说。这家公司已与“皇家一号”原房东宏信置业签订了合同,他们已接收了这里连物带设备的所有东西。


  “皇家一号”的装修的确非常豪华,根据其员工手册描述:“皇家一号”是由脸谱集团耗近2亿巨资打造的顶级国际娱乐会所,拥有豪华包间156间,英国原装进口顶级音响设备……大河报记者在三楼豪华包间看到,这里是复式造型,楼下为欧式沙发、墙上挂着油画,由于长时间的封闭,部分包间的顶棚涂料已经脱落。


  大河报记者获悉,由于这些设备没合适的地方用,只能低价贱卖。“这些装修太豪华,一般开KTV的也用不上,沙发、桌子太大,一个包间比普通包间两个还大,只能进行贱卖。”张永利说。他们已经为这些设备找好了去处,门口的吉祥搬家,将把这些设备拉走,以普通包间为例,超50万元的包间装修,仅两千多元就出售,“二手货、还用不上,只能贱卖”。门口停着3辆拉货的电动三轮车,4名民工模样的人来回装着东西。“这些是拆下来的装修材料,看着像刷了铜水的不锈钢,其实不是,不值钱。”一位工人说。他们3辆车负责拆卸和运送这些装修材料,卖的废品钱直接当工钱。“一车能卖一百来块钱,卖的钱抵工钱,我们来了四个人,三辆车,比普通收废品挣钱多一点儿。”这位工人说。


   新生:装修半年后开一家商场


  这么黄金的地段,承租下来花费多少呢?由于涉及商业机密,“宏信置业”与“永森物业”双方都没透露,不过其中一方透露每平方米月租金近100元,合同签了10多年,租金逐年递增。大河报记者粗略算了一下,按1.3万平方米计算,年租金高达1500万余元。


  拆完后,这里要做什么呢?张永利说,他们公司接手这里后,准备建一个大型商场,半年左右能装修好,目前正在进行招商工作。“有一个地产商已经同意在这里建一个楼房展厅,我们计划建一些商超、知名品牌店面,三楼引进一些主题餐厅、健身房、游泳池等绿色健康的项目。”张永利说。不过,他表示,“如果有KTV要来也不排斥”,不管是餐厅、KTV,还是健身娱乐场所,都定位做CBD都市白领能消费起的项目。绝好的位置,加上亲民的消费定位,这或许是敢接手“皇家一号”原址建商场的信心所在吧。


   疑问:房东是否有权卖租户的装修和设备?


  在这次“皇家一号”装修变身商场过程中,承租一方将原租户的装修以及设备卖掉。作为承租户,是否有权处理这些财物?对此,永森物业方面回应称,他们合同关系只对房东,与“皇家一号”经营一方无关。“我们和房东签了合同,而且这些设备不是白拿的,都是核算一定费用在里面的,我们不想牵扯太多。”该公司一位负责人说。那么,房东有权处置原租户的这些财物吗?记者希望承租方提供房东联系方式采访,没获得正面回应,通过警方了解房东信息,也没获得正面回应。


  对此,北京京师律师事务所杨立民律师认为,由于没有看到房东与“皇家一号”经营方签的租赁合同,也不知道租户是否同意房东变卖自己的财物。从法律的角度讲,房东是没有权利变卖租户财产的。“当然‘皇家一号’已经尘封两年多,房东有一定损失,房东合法的维权渠道是,向法院起诉,由法院进行公开拍卖,所得收益弥补房东的损失。”杨立民说。

  2013年11月1日深夜11时许,河南警方“异地用警”查处“皇家一号”。


  2015年5月25日郑州“皇家一号”案在新乡市中院宣判。其中陈加贵、王国付被判无期徒刑,剥夺政治权利终身。其余9人分别被判处10年到15年有期徒刑,处以8万元到100万元不等的罚金。
