中国10月起实施《网络食品安全违法行为查处办法》
中新社北京7月14日电  (记者 董子畅)中国国家食品药品监督管理总局14日在北京发布《网络食品安全违法行为查处办法》(以下简称《办法》)，该办法将于2016年10月1日起施行。
　　近年来，中国电子商务发展迅速，2015年网络零售交易额已达3.88万亿元(人民币，下同)，网络食品经营具有信息准确、交易快捷、交易跨地域等不同于食品实体交易的特点。同时网络食品安全作为新生事物也是全世界的一个监管难题。网络食品监管面临着经营主体多、地域范围广、技术水平高、法律复杂、监管能力不足、网络食品安全违法行为查处程序不明确等问题。
　　中国国家食品药品监督管理总局法制司副司长陈譻pace表示，中国在网络食品交易监管上有两个“第一”：一是全球第一个在食品安全法中明确网络食品交易第三方平台义务和相应法律责任的国家。二是第一个专门制定《网络食品安全违法行为查处办法》这样规章的国家。
　　“新修订的《食品安全法》规定了网络食品交易第三方平台提供者以及入网食品生产经营者的基本的法律义务和责任。”陈譻pace说，《办法》强化了平台和入网食品生产经营者义务，细化了严重违法行为的具体情形，明确了违法行为的管辖，强化了调查处理职责。《办法》还明确网络食品交易第三方平台提供者未按要求建立食品生产经营者审查登记、食品安全自查等制度的或者未公开以上制度的，由县级以上地方食品药品监督管理部门责令改正，给予警告；拒不改正的，处5000元以上3万元以下罚款。
