第二类为在房间内直播性行为。执法人员介绍，此类主播一般会在晚上或是凌晨进行直播，整个直播过程持续20到30分钟。“这些主播不会提前做宣传，只要进入直播房间的人就能观看。”执法人员表示，此类主播一般不以营利为目的，在直播过程中也没有和用户的交流，“这些主播被变态心理所操纵，通过这种表演方式获得关注”。

执法人员介绍，手机APP“嘿秀”是一款由用户注册成为主播后进行在线表演，其他用户在线观看的移动互联网直播平台。目前该平台上注册账号约10万个，日活跃用户5000-8000人。“较大的直播平台，日活跃用户在10万以上”。
6月30日，全国“扫黄打非”办公室、市文化执法总队、市局网安总队、朝阳网安大队对“嘿秀”的经营场所，进行联合执法检查。执法中，执法人员发现，“嘿秀”的经营公司北京雷麦尔互联网科技有限公司并没有取得《网络文化经营许可证》。
执法人员随后约谈了该平台的法人代表郝某。郝某承认“嘿秀”在直播中存在淫秽、色情的内容，且未取得《网络文化经营许可证》。
郝某狡辩道，“嘿秀”在工作中确实存在很多不足，因为公司资金链接近断裂，工作人员不足，在6月20日左右，公司被某网络色情团伙乘虚而入，该团伙进入平台后进行色情表演及广告发布。郝某称，因运营人员不足，未能在色情团伙进入后及时对部分直播房间进行关闭及封停直播账号，对网络用户造成了不良影响。
执法人员介绍，郝某之前在某互联网公司的直播平台工作。了解到直播行业赚钱后，今年3月份他辞职后创立了“北京雷麦尔互联网科技有限公司”。该公司在“嘿秀”上投入了400万，3月份上线运营以来用户充值收入100万元。
昨天记者了解到，市文化执法总队已给北京雷麦尔互联网科技有限公司送达了行政处罚事先告知书和责令改正通知书，责令“嘿秀”停业整改，并因该公司未取得《网络文化经营许可证》给予其罚款处罚。
昨天下午，记者用手机在网上搜索到“嘿秀”APP，此款APP还可以下载且能正常使用。记者注册账号后登录“嘿秀”，仍存在部分主播穿着暴露在进行直播。
记者从朝阳网安大队了解到，“嘿秀”被停业整顿后，其法人代表郝某已将其卖给了哈尔滨的一家公司。按照属地管辖原则，“嘿秀”的直播关系转到哈尔滨之后，需要哈尔滨当地的相关部门对“嘿秀”进行监督管理。

音频是直播平台监控难点
针对直播平台对直播内容的监管问题，记者采访了某直播平台的管理人员。该管理人员表示，作为平台方对直播内容的监管，主要还是看企业的监管意识，也就是平台能够投入多少人力去做直播内容的监管。
该管理人员称，平台对内容的监管通过技术和人力两种方式完成。如果平台上出现淫秽色情的直播内容，只要平台方投入足够的监管人力是一定能够解决的。技术上，现在有一套自动识别的技术，90%到95%明显的淫秽色情的内容通过这套技术都是能够识别的，一旦出现问题内容，通过这套技术会自动封停直播的账号。而剩余的其他问题，平台方需要投入人力解决。
该管理人员介绍，在人力监管上，要实现对直播内容进行7×24小时的监控，这些包括对图片、声音、视频包括文字等内容的监控。如果直播内容中出现问题，人力的监控能够保证在最短的时间内处理掉。
该管理人员还谈到，现在平台方对内容的监管难点是对音频的监控，现在的技术还不能实现对音频的实时监控，技术上也在努力解决这一问题。
关于直播内容中出现发布QQ群号等“做广告”的行为。该管理人员介绍，这些“做广告”的行为，一部分是主播有维护粉丝群的诉求，需要通过其他渠道对粉丝进行维护，还有极少的一部分是将用户转移到其他的平台进行淫秽色情表演等。这可以通过粉丝举报或是平台巡逻人员的监控解决。
该管理人员还表示，直播平台制定了一系列的监管措施之后，主播群体了解后也逐渐形成了自治机制，主播们知道哪些行为面临被封号，所以也会克制自身的行为。

主涉黄播或受到刑事处罚

中国政法大学刑事诉讼法教授洪道德表示，首先，直播内容涉黄必然违反政府主管部门的管理制度，主播本人以及所在网络经营者将受到相应的处分，轻者停业整顿，重者取消从业资格，甚至终身禁入。
其次，主播本人必然触犯《治安管理处罚法》，将受到公安机关的治安行政处罚。主播的此种行为很有可能触犯刑律，构成犯罪，将受到刑事处罚。
洪道德还谈到，观看到色情淫秽内容的观众有权利也有责任直接拨打110报警，如果观众以视觉受到污染、精神受到伤害为由请求法院处理责任者的侵权行为，那么主播本人很有可能还要承担民事法律责任。
