深圳渣土滑坡调查报告公布 区城管局长自杀免追责
深圳光明新区渣土受纳场“12·20”特别重大滑坡事故事发地（6月16日摄）。新华社发事故责任主体关系图京华时报制图 谢瑶 中国国务院近日批复了广东深圳光明新区渣土受纳场“12·20”特别重大滑坡事故调查报告。中国国务院调查组认定，这是一起特别重大生产安全责任事故。
滑坡致73死直接损失8.81亿
2015年12月20日，位于深圳市光明新区的红坳渣土受纳场发生滑坡事故，造成73人死亡，4人下落不明，17人受伤（重伤3人，轻伤14人），33栋建筑物（厂房24栋、宿舍楼3栋，私宅6栋）被损毁、掩埋，90家企业生产受影响，涉及员工4630人。事故造成直接经济损失为8.81亿元。
12月25日，在中国国务院深圳光明新区“12·20”滑坡灾害调查组排除山体滑坡、认定不属于自然地质灾害的基础上，经中国国务院批准成立事故调查组。邀请中国最高人民检察院派员参加。
受纳场未建有效的导排水系统
调查组查明，事故直接原因是：红坳受纳场没有建设有效的导排水系统，受纳场内积水未能导出排泄，致使堆填的渣土含水过饱和，形成底部软弱滑动带；严重超量超高堆填加载，下滑推力逐渐增大、稳定性降低，导致渣土失稳滑出，体积庞大的高势能滑坡体形成了巨大的冲击力，加之事发前险情处置错误，造成重大人员伤亡和财产损失。
调查认定：深圳市绿威公司为红坳受纳场运营服务项目的中标企业，违法将全部运营服务项目整体转包给深圳市益相龙公司。深圳市益相龙公司未经正规勘察和设计，违法违规组织红坳受纳场建设施工；现场作业管理混乱，违法违规开展红坳受纳场运营；无视受纳场安全风险，对事故征兆和险情处置错误。与益相龙公司有债务关系的林敏武、王明斌等人通过债权换股权的形式实际参与红坳受纳场项目运营。两家公司和实际参与运营者都是事故责任主体。
调查认定，深圳市和光明新区党委政府违法违规推动渣土受纳场建设，对有关部门存在的问题失察失管；深圳市城市管理、建设、环保、水务、规划国土等部门单位违法违规审批许可，未按规定履行日常监管职责，未有效整治和排除群众反映的红坳受纳场存在的安全隐患；广东华玺建筑设计有限公司在未经任何设计、计算和校审的情况下出具红坳受纳场施工设计图纸并伪造出图时间，从中牟利。
110人受处两企业被吊销证照
调查组对110名责任人员提出了处理意见。其中，司法机关已采取刑事强制措施的53人，包括：公安机关依法立案侦查并采取刑事强制措施的企业和中介机构人员34名，检察机关立案侦查并采取刑事强制措施的涉嫌职务犯罪人员19名。调查组另对57名相关责任人员提出了处理意见：建议对深圳市委市政府2名现任负责人和1名原负责人等49名责任人员给予党纪政纪处分，其中厅局级11人、县处级27人、科级及以下11人；建议对深圳市委、市政府主要负责人等2名责任人员进行通报批评，对深圳市有关部门的6名责任人员进行诫勉谈话。调查组还建议责成广东省政府向中国国务院作出深刻检查，责成深圳市委、市政府向广东省委、省政府作出深刻检查。
调查组建议：依法吊销深圳市益相龙公司有关证照并处罚款，企业主要负责人终身不得担任本行业生产经营单位的主要负责人；依法吊销绿威物业管理有限公司营业执照，没收违法所得并处罚款。对广东华玺建筑设计有限公司给予没收违法所得、罚款、吊销相关资质等行政处罚。

未重视举报终酿成事故
问：这起事故是如何发生的?
答：事故发生地规划库容400万立方米，封场标高95米，事故发生时实际堆填量已达583万立方米，堆填体后缘实际标高已达160米，严重超库容、超高堆填，增加了堆填体的下滑推力。加之受纳场地势南高北低,北侧基岩狭窄、凸起，导致体积庞大的高势能堆填体滑出后迅速转化为高速远程滑坡体。
事故企业现场作业人员在事发当天发现受纳场堆填体多处出现裂缝、鼓胀开裂变形后，错误采用顶部填土方式进行处理，使已经开始失稳的堆填体后缘增加了下滑推力；在发现裂缝越来越大、堆填体第4级台阶发生鼓包且鼓包不断移动后，自行撤离作业平台。
在此过程中，事故企业人员始终没有发出事故警示、未向当地政府和有关部门报告，贻误了下游工业园区和社区人员紧急避险的时机。
问：一开始说是自然灾害，后来怎么变成生产安全事故？
答：光明新区接到群众报告后，向深圳市政府总值班室报告“发生山体滑坡”。此后，中国国务院成立调查组，经调查认定，发生滑动的是受纳场渣土堆填体不是山体，不属于自然地质灾害。调查组进一步排除了人为破坏、突发降雨及地震、天然气管道爆裂、地铁施工和生活垃圾腐化等因素，查明了事故发生经过、原因，最终认定这是一起特别重大生产安全责任事故。
问：有报道称，早在2014年，红坳村村民就曾举报红坳受纳场存在安全隐患。
答：2014年10月，光明新区红坳村村民分别致信广东省委、省政府，举报红坳受纳场存在重大事故隐患。接到广东省信访局转来的信访件后，深圳市、光明新区有关负责人分别作出了批示。
调查认定，深圳市、光明新区及其有关部门对群众举报的事故隐患问题未认真核查、整改，错失消除事故隐患、避免事故发生的机会。虽然光明新区城市建设局查实并向光明新区城市管理局函告了存在的事故隐患，但是光明新区城市管理局弄虚作假答复举报人和上级机关，在仅仅补办水土保持和环境影响评价手续、未补办建设审批手续的情况下，再次为红坳受纳场核发《临时受纳场地证》，使群众举报的事故隐患持续存在并继续加重，最终酿成事故。

检察机关立案侦查25人
昨天，中国最高人民检察院透露，检察机关在介入深圳光明新区渣土受纳场“12·20”特别重大滑坡事故调查中，依法对25名涉嫌滥用职权罪、玩忽职守罪、受贿罪和行贿罪的犯罪嫌疑人立案侦查，并采取了相关强制措施。
2016年1月6日以来，检察机关先后依法对深圳市城市管理局原局长蒙敬杭、深圳市光明新区党工委委员、管委会副主任陈敏锋、深圳市规划和国土资源委员会光明管理局局长彭水清等25名犯罪嫌疑人以滥用职权罪、玩忽职守罪、受贿罪和行贿罪立案侦查，并采取了相关强制措施。
同时，检察机关依法履行审查逮捕职责，先后对公安机关报请逮捕的龙仁福、于胜利、林敏武等35名重大责任事故刑事犯罪嫌疑人批准逮捕。
区城管局长自杀免追责
在此事故调查过程中，调查组还发现了一些腐败行为和其他犯罪事实。
如光明新区城市管理局原党组书记、局长徐远安，在任职期间违反法律，权钱交易，大肆收受益相龙公司实际控制人龙仁福贿赂；滥用职权，违反规定审批红坳受纳场；玩忽职守，对红坳受纳场违法违规经营活动监管查处不力，对事故发生负有重要责任，已经涉嫌受贿罪、滥用职权罪和玩忽职守罪。鉴于徐远安在事故调查处理期间坠楼自杀身亡，建议不予追究其责任。对事故调查过程中发现的腐败行为和其他犯罪事实，司法机关仍在全力侦查。
