电子地图提供商北京四维图新科技股份有限公司（以下简称“四维图新公司”）起诉北京奇虎科技有限公司（以下简称“奇虎360公司”）侵犯其著作权，索赔1亿元。奇虎360公司则回应称，其使用的地图产品由立得空间提供，并已支付巨额的许可使用费。之后，第三方北京秀友科技有限公司（以下简称“秀友科技公司”）发表声明称，奇虎360公司实际已获得授权。
澎湃新闻近日从北京海淀法院获悉，四维图新公司于7月12日申请撤回对奇虎360公司侵犯著作权和不正当竞争的起诉，该院已准许其撤诉。
诉360侵权索赔1亿，一月后撤诉
2016年6月，因认为奇虎360公司未经许可，在导航电子地图、应用软件“360搜索”中使用的电子地图侵犯了自己的著作权，四维图新公司将奇虎360公司诉至法院，要求其停止侵权、赔礼道歉，赔偿损失1亿元及合理支出100万元等。
6月6日，北京海淀法院官方微博发布消息称，该院已受理此案。
上述消息显示，四维图新公司起诉称，公司长期投入大量人力、物力研发中国电子地图，每年对地理信息实况变化进行跟踪测绘，并根据道路变化不断升级电子地图版，对以上电子地图享有独立、完整的著作权。奇虎360公司未经许可，以商业经营为目的，在提供的导航电子地图及开发的安卓和IOS平台应用软件“360搜索”APP中使用原告享有著作权的电子地图。此外，奇虎360公司误导消费者其提供的地图具有合法来源，构成不正当竞争行为。
四维图新公司还认为，奇虎360公司在获取自身巨大利益的同时，给四维图新公司造成了巨大的经济损失。
在起诉要求巨额赔偿一个月之后，四维图新公司却又做出了新的选择。7月12日，该公司申请撤回对奇虎360公司侵犯著作权和不正当竞争的起诉，并获海淀法院准许。
奇虎地图数据提供商子公司称360已获授权并付费
据《北京青年报》报道，针对四维图新公司的起诉，奇虎360公司曾回应称，360地图产品中使用的导航电子地图全部由拥有导航电子地图制作资质的立得空间集团提供，双方签订了合法有效的许可使用协议，奇虎360公司为此已经支付了巨额的许可使用费。
此后，又有另一家公司站出来力挺奇虎360公司。
据《中国知识产权报》报道，6月12日，立得空间集团旗下一家从事互联网地图服务的公司——秀友科技公司发表声明称，2014年4月1日，秀友科技公司与四维图新公司签订了为期3年的有关地图数据许可的合作协议，获得了四维图新公司地图及相关数据的合法授权，秀友科技公司向四维图新公司支付了许可使用费。
该声明还称，2014年4月25日，秀友科技公司与奇虎360公司签订了地图数据服务许可协议，按照上述四维图新公司的授权为奇虎360公司提供地图数据服务。奇虎360公司依照协议约定合法使用相关服务，并支付了许可使用费。
秀友科技公司表示，其与四维图新公司和奇虎360公司分别签订的合作协议已顺利执行2年多，至今仍然合法有效；奇虎360公司不存在侵犯四维图新公司地图著作权及不正当竞争的行为。
