账户余额不翼而飞

据消费者鲁先生自述,5月24日他参加易到充值赠乐视电视活动,充了3300元。后因易到发送的兑换码无效,鲁先生与易到几经沟通至今没有结果。7月16日夜间,他手机突然接到易到发来的短信。“短信说更改账户失效,当时我就糊涂了,我压根也没更改过账户啊”。

鲁先生称,第二天他打开易到APP,发现自己账户内的3000元已不翼而飞。“我发现账户名已经改成另外一个手机号了,我给易到打电话,他们说只有机主打电话申请更改,才有可能更改账户名”。不过鲁先生表示,他从未向易到提交过类似申请。

短时多笔大额订单

至于账户内的数千余额为何“凭空”消失,鲁先生称他进入APP“余额明细”里,发现有数笔大额订单支付信息,而且均集中在短时间内。

在他发来的截图中,记者看到仅7月17日凌晨0点21分至1点56分,短短1个多小时时间,就分别出现了200元、878元和873元的三笔订单,其中后两笔订单时间仅相隔3分钟。而在前一天的11点20分至11点43分,也分别有两笔491元和187元的订单。

“这么短的时间,根本不可能出现这么多笔大额订单,而且打车地点都在河南,我怎么可能去河南打车。”鲁先生提供的另一张截图中,记者发现APP“我的行程”里显示在十几分钟时间里,有两笔订单的终点位置为同一地点。鲁先生认为,账户里的余额是被人更改账户后恶意套现走了。鲁先生称,如易到可提供申请修改账户的来电时间,他愿提供通话清单加以证明。

记者另外还联系到了一位出现类似情况的消费者,身在安徽的易到用户崔先生称,自己账户余额同样出现了莫名其妙的异地用车订单。“我账户里有不到1000元钱,6月底时我发现账户里出现了三四笔河南的叫车记录,总共消费掉了七八百元,可我从没去过河南”。

崔先生和鲁先生表示,在察觉到账户异常后,就将问题反映给了易到方面,不过没有得到明确回复。

从后台数据看没有异常

易到公关部相关人员昨日回复记者,经过调查,客服对鲁先生及崔先生的账户进行修改,均是在接到与账户名相同的手机号码来电申请后做出的,根据易到规定,如账户名电话来电,可以直接修改为新的账户。对于鲁先生账户出现的大额订单,该工作人员称,经核对该订单为替他人叫车这一类型,从后台数据看没有异常,没有超出风控范围,也并非刷单。目前怀疑是客户账户被盗。另外,鲁先生和崔先生所反映的情况本身有些奇怪,存在故意曝光的可能性。不过记者询问是否可提供后台数据加以证明,该工作人员表示不方便提供。

■专家说法

应保障消费者财产不受损害

中国消法研究会副秘书长、消费者网主编陈音江认为,根据《消费者权益保护法》规定,消费者在购买、使用商品和接受服务时享有人身、财产安全不受损害的权利。“也就是说,经营者对消费者未尽到安全保障义务,造成消费者人身财产损害的,应当依照法律规定承担赔偿损失等民事责任。”陈音江称,消费者通过易到平台消费,易到有义务采取技术、管理手段保证自身提供的账户和服务的安全,避免他人利用其平台有关技术或管理漏洞盗取消费者账号。

陈音江表示,“如果消费者反映的情况属实,资金是因平台未尽到安全保障义务被盗,平台应先行赔偿消费者损失,后可向不法分子追偿。”
