本报讯 出家人本应六根清净，恪守清规戒律，然而江西省会昌县吉祥寺住持韩某却上演了一幕利用职务之便侵占资金炒股旅游的闹剧。近日，江西省会昌县人民法院对该起案件进行了审理，被告人韩某因职务侵占罪被判处有期徒刑八个月。
2015年4月7日，韩某被会昌县小密乡吉祥寺理事会聘任为该寺住持，负责管理吉祥寺资金及日常事务。2015年4月至2015年10月，韩某在担任该寺住持期间，利用管理吉祥寺资金的职务之便，私自将该寺资金用于个人炒股和旅游，将经手的资金挥霍一空。
韩某自觉无法向寺里交代，于是在2015年10月15日上午谎称自己要外出一段时间，最少半个月，并留下530元伙食费给该寺人员郭某。伙食费用完后，工作人员多次电话催促韩某早点回寺未果。2015年11月12日，韩某发短信威胁吉祥寺理事会会长游某不能报警，否则不归还资金。经查，韩某任吉祥寺住持期间财务账上资金共计67889.52元，韩某侵占该寺款项共计67359.52元。
2015年12月25日，韩某在佛山市顺德区被当地民警抓获归案。
法院经审理认为，被告人韩某以非法占有为目的，利用其担任吉祥寺住持管理该寺资金的职务便利，非法侵占吉祥寺资金共计人民币67359.52元用于个人开销，数额较大，其行为构成职务侵占罪。韩某归案后如实供述自己的犯罪事实，庭审中认罪态度良好，且退回全部赃款，依法可从轻处罚。根据被告人犯罪事实、性质、情节以及对社会的危害程度，遂作出上述判决。
